FORMS & GUIDELINES TO HESI FORMS BELOW

If you were paid by the Neutrals, answer No to Question 1a, No to Question 2 and Yes to Question 3 and print off to the side “Paid by Neutrals”. Do not answer any of the remaining questions. You must include a copy of your settlement documents from them with the Claim Form. Please check the section of the Claim Form that identifies your type of claim and provide the appropriate SWS form and all documentation requested in that section.

If you were an “excluded” category under DHECC, you are eligible to participate in the HESI Settlement. Answer No to Questions 1-5, Answer Yes to Question 6, Ignore Question 7. For Question 8, check Yes, IF you filed a short form joinder and made presentment to the Court during the DHECC settlement and you have the paperwork to prove it. If you do not have these documents, you are not eligible to file a claim. Excluded category claimants do NOT fill out any SWS forms but must include their Federal Income Taxes for 2009-2011, 2009-2011 Profit and Loss Statements if available, copy of Articles of Incorporation or Organization (businesses), copy of Driver’s License, Copy of Business License(s).

If you were denied because you Opted Out of the DHECC Settlement AND you filed a short form joinder and made presentment to the Court during the DHECC settlement and you have the paperwork to prove it, Answer Yes to Question 1a, No to 1b, Yes to 1c and then Yes to Question 8. Do not answer any of the other questions. This paperwork must go into your packet with the Claim Form. Complete any SWS forms required for your claim type.

If you Opted Out of DHECC AND you filed a short form joinder and made presentment to the Court during the DHECC settlement and you have the paperwork to prove it, Answer No to Questions 1-3, Yes, to Question 4 and Yes to Question 8. Do not answer any of the other questions. This paperwork must go into your packet with the Claim Form. Complete any SWS forms required for your claim type.

If you are a person that sustained personal property damage in excess of $500 as a result of the oil spill, but your claim “type” wasn’t recognized under the DECC Claim Types, Answer No to Questions 1-6, Answer Yes to Questions 7 and 8 IF you filed a short form joinder and made presentment to the Court during the DHECC settlement and you have the paperwork to prove it. This must be included with your Claim Form. You will also need to complete an SWS1.

If you have a valid and payable DHECC claim, the only FORM needed for representation engagement is the STATEMENT OF CLIENTS RIGHTS FORM. 

If you received payment under GCCF and signed a release, you are NOT eligible to participate – do NOT complete a claim form.

If you were denied under DHECC for any reason other than a valid Opt-Out, you are NOT eligible to participate – do NOT complete a claim form.

If you withdrew your claim due to a Fraud, Waste and Abuse (FWA) Notice, you are NOT eligible to participate.

 

 

 

A positive Donald Trump Poll “Go Figure”

bp attorneysI have to tell you this election reminds me of the oil spill. They make you shift focus through media, to hide the true disaster  of whats right in front of our face.

As I thought, the Trump numbers would be much better then we had been told by the media. Does this remind anyone of flow rates on the bottom of the Gulf.

Donald Trump Leads Hilary Clinton by almost 3-1 in The BPClaims.org poll.

Just Under 10,000 people received an email almost 700 responded. Those are fantastic results.

It covers a  wide spectrum of ethnicity and incomes, it was a solid sample set.

But the numbers we hear are much different, and they definitely remind me of an Oil Spill when Barak Obama was our President, and Hillary Clinton voted for the Gulf of Mexico Energy Bill  “after the bill passed,” BP obtained the fateful permit to drill that resulted in the deadly and costly tragedy.

I JUST think we all need to remember that right now.

Since we decided along time ago, basically day 1, this was not just going to be about the money for us, we decided it was time to tackle some other issues.

This is just the beginning.

So it was time to go in some new directions, and what could be more timely then these Presidential Elections.

Lets face it Obama did not do a stellar job of how he handled the oil spill, and many people still blame Hillary for a number of fatal flaws whether National or International in scope. With Wikileaks getting drowned out by locker room talk, we really need to reevaluate a few things.

But the Biggest Issue I have seen and heard about from others is the lack of impartiality from the Media outlets. We live in a FREE country, but that comes with consequences, and when big companies feel threatened, they put their advertising dollars in action, and support the news outlets that support their candidates.

For instance CNN has been nicknamed the Clinton News Network.

Is this really the America we want, and would campaign caps really help.

Now I am not saying I am pro Trump, but I am pro fairness, and after what I have seen with the outcomes for many regarding the BP Oil Spill, things need to be fixed, but that`s for another Blog.

I thought that we had a pretty good sample set as the victims of the oil spill has everyone from clean up workers to business owners, and those in between.

bp claimsBP Claims on the whole still seem to be picking up speed again as they are clearly trying to put the remaining BP Claims to bed.

If you are getting hit with incomplete notices, take them seriously, if you are asking for extensions they are not as easy to obtain, it seems that the patience and understanding of DHECC is coming to an understanding end in some cases.

We are also hearing from many people who are seriously sick and frustrated with the BP Medical Settlement. The number of people that we have been talking with, have different types of cancer, many of these cancers are not at all common and has greatly increased, and I think it will for some time. As the BP Claims continue to settle we are seeing many attorneys and others involved begin to squabble or settle amicably over payments owed between the parties. Many attorneys and others involved in the BP Settlement deferred payments to each other until the claims were paid.

A certain Attorney based out of Venice, Florida, not only fired many of her clients, but cut a side deal with another law firm to still get paid from claimants she had released, now that`s shady.

For us We always put people before profits, the job is nearing an end for many economically, but environmentally I think we have just begun to see the true ramifications.

Institutional BP Claims buyers are Specializing claims over 3m, claim purchases of 50m-100m are not uncommon.

Our own operation took a serious hit when BP stopped paying claims, but we never gave up and due to the nature of how we structured our network, we were blessed that one member started seeing our largest claims get settled first.

The first claim was over 4.5 million dollars.

This particular processor has had over 40 claims paid to our clients since they began paying again, and their calculations have been almost dead on.  This particular processor has a system in place that works.  Not only do they have CPA’s and analysts who thoroughly understand the claim calculations and methodology established by the Deepwater Horizon Settlement and the appeals that followed, they go one step further and direct each and every claimant to obtain an attorney to represent them with any and all legal issues/questions and appeals.

It`s time to get People Paid and there is no room for mistakes.

As I write this we have seen some of our largest claims processed and paid in the last month. Most of these claims are over a million dollars, others in the high 6 digit range. We have also seen the devastating affect that rule 495 can have on claims, and how some rulings can be successfully  appealed while others can not.

BP has just settled with the states, local and Federal government.

Claims that are currently in the Deep Water Horizon Settlement system, will have one FINAL opportunity to be paid.

There is no room for error, but as we have begun taking over claims from other Processors/Attorneys/Claimants who started doing this years ago, it is easy to see why so many of you have not been paid.

The financials that many uploaded are atrocious. Others just kept supplying the same paperwork and expected different answers when tasked with an incomplete notices.

And far too many of you were making huge mistakes when you put these claims together, many in the beginning just did not understand what the settlement asked for. These claims are typically 2 years or older.

This is not the time to throw stuff against the wall and see what sticks, nor was it ever, but it is what too many did in the beginning.

Most processors  have stopped taking on BP Claims, we haven`t but you have to have all your information together and be ready to expedite it directly over to us.

If you would like help processing your claim after the 8th we will be happy to help you, but you need to be filed with Deep Water that is the most important step right now.

The attorneys we work with are available if your claim documentation is in order.

Recently we have seen lots of emails from the heads of the PSC that definitively speak about having the claims that are being entered at this time to be complete, we agree with that, but in speaking with one of our liaisons at Deep Water he wrote us this.

You must submit a completed and signed Claim Form on or before Midnight (Prevailing Central Time) on June 8, 2015. You should submit all required documentation in support of your claim at that time. If the Claims Administrator finds that your claim is incomplete for a Registration Form, or documentation necessary to complete the review of the claim, the Settlement Program will notify you of that determination by email or mail at the address you provided in your Claim Form. That notification letter will provide you with instructions for how to make your claim complete and will provide a specific deadline by which you must respond.

Keep in mind how the time of filing a Claim Form is measured. The Claims Administrator applies these rules:

  1. Claim Form filed online on a DWH Portal or by email: Timely if submitted online or emailed by midnight Central Prevailing Time on the filing deadline date.
  2. Claim Form filed in a Claimant Assistance Center: Timely if done in a Claimant Assistance Center before the Center closes on the deadline date. The Claimant Assistance Centers will remain open until midnight prevailing central time (1:00 a.m. eastern time) on June 8, 2015, to accept claim forms and documentation submitted in support of claims. After June 8, 2015, you may continue to visit the Claimant Assistance Centers during normal business hours from 9:00 a.m. to 5:00 p.m. local time until June 19, 2015, on which date the centers will permanently close to the public.
  3. Claim Form filed by U.S. Mail: Timely if postmarked on or before the filing deadline date.
  4. Claim Form filed by personal delivery: Timely if delivered on or before the filing deadline date.

The key word here being should, so in an effort to accommodate as many of you as possible, if your business claim passes our screening process, we will do everything we can, to get your Business Claims in before the deadline.

We strongly suggest that You ALL check the status of your BP Claims by going here, as many claims were dropped during the stay, many of you were refiled, some with your knowledge, but many with out your knowledge, by the Groups handling your claims.

Many were just dropped.

Many of you just don`t know, and the best place to go is the check your status page on the Deep Water Horizon Settlement website.

If you are unsure, contact whoever is processing your claims, I strongly suggest you check there first.

However if you did not opt out, and feel you have a bp claim that is viable, and you have checked you status, you may want to file your claim yourself before the 8th.

BP Claims are due June 8th

The BP Claims Settlement is Back On and time is running out..

bp settlementThe final stage of the BP claims process is quickly unfolding. After so many exhausting delays, it is furiously up and running once again with checks being mailed out every day.

Emails and letters are being sent by the leadership of the Settlement in mass.

However, the deadline to file of June 8 is fast approaching and requires immediate action.

We have found that many claimants have fallen through the cracks when indeed they had a justifiable business claim.

This was either due to mishandling by certain claims professionals or the confusion created by the complicated, and to some, misleading filing process.

If you wish to get professional help to revive and old claim,  or move your claim from one processor to another or yourself, all you need to use is an AR1 form. here is a link to one.
If an Attorney/Processor has done their job, expect them to lien the file.

Judge Barbier has not taken kindly to Attorneys/Processors liening files that he found to have little or know time in.

The claimants still have RIGHTS, and need to know what they can do to keep their claims alive.

The mishandling of claims from certain vendors inside the settlement can not be ignored.

In my opinion hiring people unskilled in this process was a huge detriment to the whole settlement, and it is my belief,  it intentionally was meant to thwart the whole process, and Pat Juneau and his staff became targets for trying to fix it, and thank God they did to a large degree by bringing in some very good processors and reworking the mess that was handed to them.

How BP Claims got lost in the shuffle

When the claims process was switched from GCCF to Deep Water Horizon, many claimants never fully transferred to the new process. Their information did, but needed forms, that to many looked like junk mail, were thrown in the trash.

Those claims can be brought back to life, your documents are still there.

The amount of people that had filed through the GCCF before transitioning over to the New DeepWater Horizon Settlement was around 1 Million.

The amount of claims ever filed with DeepWater far, far less.

The claim process was then halted during the Deepwater Horizon Settlement by Delay tactics by BP.

New rules like 495 and smoothing and matching tests were added.

What happened in many experts opinions is that 25% or so of what were thought to be solid claims will be ineligible, and will be documented to death.

What also happened was that the connection between the oil spill no longer applied for most Business Economic Loss Claims.

If your Business Claim meets the V Trend model for your zone you could get paid.

You just have to show a loss in 2010 for 90 or more consecutive days versus the same period in 2009, and an upswing for the same 90 or plus days in 2011. These ups and downs that make the V-Trend are different for every zone, and there are exceptions.

If you can also demonstrate you had even better numbers in 2007 and 2008 during those same 90 plus days you can also bring those years into the equation.

The critical dates in determining a loss are from 4/20/10 ( the day of the spill) to 11/31/10. for more on the V Trend go here.

You will need monthly p and l`s and tax records for the years and the time periods you use to substantiate your claim.

At this point in time keeping good records is a must to qualify for the settlement. Many of those records are still sitting  in the DeepWater Database and just need to be revived.
