Seafood Compensation Claims May still be OPEN

There is a new disclaimer that has appeared on the DeepWater Horizon Website

In layman’s terms this disclaimer states that the deadline to file all Seafood Compensation claims was January 22, 2013 BUT that if you have a Seafood Compensation claim that has not yet been submitted that you may still file it at this time and it will be reviewed on a case by case basis. There are no guarantees any of these claims will be accepted but claimants will be notified on the outcome of the timeliness review.

Menhaden Fishing  Significantly Down

Key figures in the Menhaden Fishing Industry have stated that the fishery is suffering. According to very credible reports given to us at BPClaims.org, the fishery is running around 20%-40% of what it was before the Gulf Oil Spill. This is eerily reminiscent of what happened to the Herring after the Valdez Spill. The fishery seemed stable for 3 years after that spill, and then collapsed. The sad fact is this environmental aftermath is still unfolding. The oil sitting on the bottom of the Gulf of Mexico may continue to cause unforeseen problems for years to come.

DeepWater Horizon Settlement Issues

A vast amount of claimants who contact us do so because they continue to receive incompleteness notices on their case. There are many reasons for these. Deepwater Horizon many times may ask for documentation that you have already submitted. We are not hearing this just from unrepresented individuals and businesses, but also from Attorneys, Processors, and CPA Firms.  Professionals in this Industry are unhappy, and making it known to the leadership of the BP Settlement and their liaisons. We sa this in the beginning of the BP Settlement, but have not seen this for some time.

Quite often instead of receiving an incompleteness notice, we receive a phone call from Postlethwaite & Netterville, this is the accounting group that the Deepwater Horizon Leadership has brought in, and they have done an excellent job. We have not had any issues with Postlethwaite & Netterville, when it comes to being asked for documentation that was already submitted. As I understand it from the people I have talked to, Brown Greer was in charge of those particular claims.

Let’s all remember that Ken Feinberg is the one who hired Brown Greer. Who hired Ken Feinberg? By now we know he was not Independent as he originally advertised; he was bought and paid for by BP. Before anyone could tell what the full extent of damage from the spill would be, Feinberg initially promised to begin compensating the affected with Interim Payments. Instead, he offered Quick Pays and many people had no choice but to take a small amount of money and waive their right to sue BP in the future. Many had lost everything they had and were desperate to put food on the table for their families. Over 200,000 Individuals and Businesses took Quick Pays and many of those were given much less than what they should have rightfully received.

For the record, The Claims Administrator inherited Brown Greer. As I understand it, and I could be wrong, their continued involvement was part of the Settlement Agreement, and BP wanted them in play.

To the leadership’s credit, they foresaw issues from the beginning of the Settlement process and got the accounting firm Postlethwaite & Netterville involved. We deal with P&N quite often when processing your claims and have found them to be most helpful.

GCCF Claims Need to be Updated

Think about this, just under a Million Claims were at the GCCF when they transitioned over to the DeepWater Horizon Settlement. We were told that the information from the GCCF would go right over to the NEW and Improved BP Settlement. It did, but what many people don’t understand is that they still need to update that information to meet the terms of the Settlement. This has been seriously frustrating to many of you who think your claim is still Live at the DeepWater Horizon Settlement. In fact, it is not. Your claim will need to be updated to meet the guidelines of Deepwater Horizon Settlement. The only advantage is that much of your documentation is digitally available, which may make it easier to prepare the claim.

BP`s 5th Circuit Appeal

BP is rumored to have asked Prime Minister David Cameron to intervene on their behalf, and I am sure they have, even though they deny it. Most Attorneys that I speak to don’t think there will be ANY changes when this case gets to the 5th Circuit, but my gut tells me otherwise. In looking at past decisions of the 5th Circuit, they have no problem reversing decisions from the lower courts. If you read the writing on the wall, BP is posturing that this settlement could mean the end of them, and they are appealing to the U.K. leadership to ensure that does not happen. If only they spent this much time and energy harboring a corporate culture that did not put money before safety. It has been proven multiple times they do not. BP has a history of putting money before safety.

If BP gets their way in the 5th Circuit, and eliminates multiple categories within the construction, agriculture, marketing/advertising, and professional fields, these industries will become excluded. They will have in essence, rewritten the BP Settlement. If that is to be the case, may I suggest that since the settlement is being rewritten; let’s allow ALL of the people that took Quick Pays to come back into play. If BP truly wants to make things right, as they are stating in their commercials, let’s bring back the Quick Pays and allow them to be reconsidered since they were preyed upon by Feinberg anyway.

Quick Pays

Besides the explosion and the environmental catastrophe that followed, Quick Pays are perhaps the most devastating aspect of this event. Good people, mostly those that made their living for generations from the Gulf were the hardest hit. Many had little education and had no idea what they were signing. Feinberg came out with the program around Christmas 2010, but it would not hit high gear until April 2011, one year after the spill.

By that time homes were in foreclosure, boats were being repossessed, and people were desperate for money. The 5k or 25k payments were nothing short of extortion.  If BP is going to have the ability to rewrite the settlement, let’s bring Quick Pays back to the table as well. If they’re going to take away, they should give something back in return. Since BP is now stating that the groups that they are trying to exclude were not injured by the Gulf Oil Spill, let’s make sure they help the people that were, and truly make things right, just like their commercials say.

Recent BP Settlement History:

  • BP sues Pat Juneau for misinterpreting how he is suppose to administer funds under the terms of the BP Settlement. Let me tell you something, we process many BP Claims in house and these people stick to the letter of the Settlement. All BP wants to do here is exclude certain categories, professionals, construction, media, and agriculture are the prominent.
  • BP has tried several times to rewrite the BP Settlement, and tried to enroll the Judge and the P.S.C. The P.S.C. and the Judge have stood firmly, holding BP to the terms of the Settlement.
  • BP uses appeals as a method to stall payments, overwhelming the DeepWater Horizon Settlement Appeals Process.
  • BP sets up traps within the BP Settlement, such as the Customer Mix Test, if a Claimant is not covered under a straightforward V Trend model, most will never see a dime. We are woking to fix that.
  • BP agrees to pay stockholders 8.5 Billion for losses and expedites payments, but not the people of the Gulf.
  • BP hires Feinberg who declares himself Independent until the Judge ORDERS him to Stop, meanwhile over 200,000 people take his devilish Quickpays.
  • BP now appeals Judge Barbiers Decision to the 5th Circuit, and wants to eliminate dozens of categories they initially agreed to pay under the terms of the BP Settlement.

The DeepWater Horizon Settlement has accelerated it`s processing capabilities. Postlethwaite & Netterville, the accounting firm that is now handling the majority of the BP Claims seems to be doing a good job, at the very least, much better then their predecessor. BP Settlement and the 5th Circuit

BP Appeals to the 5th Circuit

bp settlement  BP will be appealing Judge Barbier`s decision to the 5th circuit.

This means that many different types of claims could be excluded from the economic settlement.

BP has asked the 5th circuit to expedite the hearing and they have agreed.

The 5th circuit has decided to hear BP`s appeal around the end of May. Link to Article.

If your claim is one of those appealed by BP, and the 5th circuit reverses Judge Barbier, you will not be able to make further claims to the DeepWater Horizon Settlement.

If your claim is filed before the potential reversal,  the common thought is your BP Claims will be grandfathered in, but they will have to meet some prerequisites.

 Moving BP Claims from one group to another

Judge Barbier Stands Up for You

Judge Barbier and BP Appeals

bp settlement    Too often lately, people have questioned, are we at BPClaims.org associated with the DeepWater Horizon Settlement Fund because of our stance that the folks who run the fund, and the Judge are actually not in BP`s pockets, and are actually doing battle for you the people.

We aren`t, if you look at past posts we have blasted Feinberg, pointed out the errors of the new fund, specifically a processor we don`t hear much from these days, and aggressively pursue what we think is the TRUTH.

This is the TRUTH. The new leadership of the fund and the Judge are doing the next right thing on a regular basis. Is the system perfect, hell no, but people within the Fund and the Judge are doing their best to get you paid, as BP has tried their best to put up road blocks.

Their Latest road block has been putting BP Claims into Appeals.

Tonight The Judge put forth an Order to STOP that. Here is the important part.

 

IT IS ORDERED THAT:

1. Upon the filing of an appeal pursuant to Section 6.1.2.4 of the Settlement Agreement, BP shall clearly and specifically designate in the Reason for Appeal section of its BP Portal that the appeal is based only on one or more of the legal issues previously decided by the Court and as referenced in this Court’s Order of April 9, 2013.

2. The required designations to be provided by BP shall use the following specific language regarding the three legal issues referenced in this Court’s prior rulings:
(a) “Contributions/Grant Revenue for Non-Profits issue;”
(b) “Alternative Causation issue;” or

(c) “Matching of Revenue and Expenses issue.”

3. For any appeals so designated, such appeals are hereby denied based on this Court’s prior rulings. The Claims Administrator is instructed to refrain from issuing the Notice of Appeal, which would otherwise trigger the further appeals process, and the Claims Administrator is to refrain from assigning such appeals to an Appeal Panel. The Claims Administrator is instructed to proceed with final processing of such claims and issuing payment in accord with the terms of the applicable Eligibility Notice.

So What Does This Mean

It means the Judge is not going to let BP Appeal Claims, so they can stall paying you, when your claims meet the above requirements. This has been going on for awhile now, and it is BP`s latest stall tactic, and the Judge just took it away, by a court order.

It means faster pay outs, it shows what I have been trying to tell ya`ll for months, and it puts BP on notice, The DeepWater Horizon Settlement, and the people running the show are not to be trifled with, and they ALL have had enough.The fact is they want to pay you, and will, if your claim is prepared properly. The sad fact is, most are not.

BP needs to STOP with the gamesmanship, and start paying claims. Stall tactics through the Appeals system run by David Duval, that will only tax the resources of the Deepwater Horizon Settlement will not be tolerated.

BP tries to Wiggle

deepwater horizon settlement Just for the record, I am going to say, “I told you so.”  While everyone was booing the folks that run the settlement, and some thought they were in BP`s pockets, these folks were on your side. Nothing could have proved it more than the stance the BP Settlement Leadership has taken against BP in recent weeks and months as BP tries to change the terms of the BP Settlement. I do understand many peoples’ frustrations, as BP Claims are slow to get paid. Please understand the claims are getting paid, and the people that run the program have multiple issues to deal with, such as this assault from BP.
Even the Plaintiff Steering Committee has come armed to the teeth to defend your rights under the settlement. I have read the most recent documents the PSC has presented to the court, and they are awesome. They stood up for the people, they were relentless in attacking BP`s stance, and they were right.

BP is trying to wiggle; they have realized uncapping the economic settlement was not a good idea, even with their traps, such as the Customer Mix Test, putting deadlines for people with Seafood Compensation Claims, fraudulent OPA deadlines, and the list goes on. I am not an Attorney, but this is what I believe. They cut a deal that they are trying to back out of and that is the fact.

BP is out to screw you; shocking but true. First they gave you Feinberg, who claimed himself Independent until the Judge stopped him from saying that by a court order; as they were paying him an exorbitant amount of money. At the same time he was convincing people, specifically those in the seafood industry, to accept quick pays. Unfortunately, after he starved them out, over 200,000 people took them. They should be able to come back to the table.

Then they negotiate a Settlement that they agree to, and after they realize how much they may actually have to pay, they want out. All of this on the heels of the news that they knew an explosion could be imminent days before it actually happened.

What to expect from the hearing on the 5th? Nothing. The Judge will rightfully hold BP to the settlement, BP will appeal to the 5th circuit, claims will continue to get paid, and eventually BP will have to pony up. They will not be able to wiggle out of this one.

However, if BP gets their way, construction folks, professional people and AG families will all be under fire, and probably apt not to get paid. If I fell into one of these categories I would make sure my BP Claims were filed sooner rather than later.

So all of those commercials you see on TV, the hype, the PR machine, it`s all BS and BP is proving that in court. If they were people of their word, and they are not, they would be living up to the terms they agreed to under the BP Settlement. It`s just that simple. My Grandfather always said, look at people’s actions, not their words, and he was never more right.

BP Seeks to Exclude certain Industry Groups from the Settlement

BP Settlement and a few new wrinkles: maybe

BP SettlementJust when you think the BP Settlement is what it is, and yes there are a few things wrong with it, a contingent of Plaintiff Attorneys (who have some valid points) and BP want to change things.

It is apparent that Pat Juneau and Judge Barbier are sticking to the letter of the Settlement, but outside forces would like to change all of that, and just might, and that could affect a lot of people – if BP Gets their Way.

At this point BP is actually suing Pat Juneau the Claims Administrator of the BP Settlement – Shame on them, tactics such as these could be construed by some as extortion.

If BP can manipulate the courts and the Settlement, and they are trying, numerous groups could be excluded from the Settlement. If your claim falls into an excluded group, but it is already in the settlement, you are considered Grandfathered in.

Claim Groups BP is trying to Exclude

Most notable are Contractors, Farmers, Aquaculture, Media Companies, and Doctors. Lawyers are also on the list.

Why is BP trying to change the BP Settlement –  basically because they have started to see the numbers roll in from these groups, and they are staggering. Some have told me that BP is not happy with their Attorneys who created the initial Settlement.

The Reality is, it`s all about money, when it should be, recognizing the trickle down effect this horrific event had on our economy and our ecology.

The Gulf Coast Region was in a recovery from the Housing Disaster when this happened, and the Oil Spill knocked that recovery back 3 years.
Many industries were affected, as the recovery was knocked for a loop by BP. To this day I can not think of one Industry that did not feel the affect.

BP Approves over 8 Billion Dollar Payout –  Was it to the Victims of the Oil Spill?  No, it was to it`s Shareholders.  It is suppose to be paid out in the next 12-18 months, that`s a whole lot faster then it got the money to the Victims of the Oil Spill. This is typical of how BP thinks, putting their own in front of what should be a priority of the majority.

IF a deal is cut between BP and the PSC and approved by the Judge, or if it is approved by the Courts, any of the below Industries could be out of the Settlement, if they have not yet filed with the Deep Water Horizon Settlement. If you have filed with the Settlement, you are grandfathered in so to speak.

My thoughts, and I am not a lawyer, is I would make sure that my BP Settlement Claims got filed ASAP.

The Hearing on  “BP’S EMERGENCY MOTION FOR A PRELIMINARY INJUNCTION AGAINST THE CLAIMS ADMINISTRATOR AND SETTLEMENT PROGRAM TO ENJOIN PAYMENTS AND AWARDS FOR BUSINESS ECONOMIC LOSS CLAIMS BASED ON FICTITIOUS “LOSSES””  is scheduled for April 5th.

We feel time is of the Essence to get Claims in that could be Excluded, into the BP Settlement, so they are grandfathered in.

BP Settlement exceeds BP`s Estimate

The 7.8 Billion won`t cover the BP Settlement

bp settlement  7.8 Billion Dollars will not be enough to cover the BP Settlement.  We had told you this before, when they first announced this number, the 7.8 Billion was pie in the sky. The real number will exceed 20 Billion Dollars, that is our projection.  Remember the BP Settlement is uncapped except for those with seafood compensation claims, and that still doesn`t make any sense. You would think that the fishermen on the front lines of this whole disaster would be the ones uncapped.

Fox news reported today that BP will not even release new projections, and that is probably a good idea. Over the last several weeks BP has tried to restrict certain types of claims and tighten up qualifications for existing claims, but the Leadership has fought back, and won the first round. BP does not want to live up to the deal they originally cut, what a shocker. Evidently they may appeal to the 5th circuit.

One Check List for BP Settlement Incomplete’s

So what is BP doing to thwart the BP Claims process, they are called incomplete notices, appeals, and whatever else they can think of. Instead of giving us one checklist to tell us where a claim is deficient, we are receiving an incomplete notice each time a claim needs to be amended. So understand this, and this is very important, each time a claim is given an incomplete notice, it has to go back in the que, when it goes through processing for the second time, it may very well be given an incomplete notice again, traditionally we are seeing that take 2-6 weeks, then the claim gets hit with another incomplete notice and then again another 2-6 weeks. This area of the BP Claims process is clearly broken.

We need ONE CHECKLIST, to cure all the deficiencies, we have been calling for this for months.

At the same time we are seeing BP Settlement Claims get paid, but they are the smaller ones. They seem to be working their way up the ladder, saving the big ones for last. Many of the people in this business I speak to on a daily basis, think this is exactly what they are doing, and so do I. BP Claims should be paid on a first in, and a first out basis, size shouldn`t matter, all though we all know size does.

DeepWater Horizon Settlement to liberal: Really

BP has taken the stance that the Deepwater Horizon Settlement Leadership was too liberal, with some of the initial payouts, and tried to tighten things down over the last several months. The Judge and Patrick Juneau have stemmed this recent BP assault, we will see if  payouts come on a more consistent basis, specifically the larger claims. Time will tell.

The fact remains we are seeing some firms and processors get paid on a more consistent basis then other firms and processors. Many groups have stopped taking on BP Settlement Claims out of frustration with the process. Not us, we are in this for the long haul, we have have been here from the beginning, and we will be here to the end, whenever that is.

Deepwater Horizon Settlement Stays Released

The BP Settlement lifts Stays

deepwater horizon settlement  Most people don`t know that certain groups of claims were on hold, Contractors, Farmers, Marketing Firms, Aquaculture Farming, Attorneys, CPA`s, Doctors, and quite a few more industries were just stalled. It was by design, BP and the Fund, were stalling these claims, as they sorted things out, and today Judge Barbier put a stop to it. The Deepwater Horizon Settlement led by Patrick Juneau with the help of Judge Barbier went to bat for the people. The people won.

This process has not been easy for many, about 2 days ago we were given a list of these stayed claims, it was something we thought was happening, but we had not seen it in black and white, this was an official list, it should have been made  available to the general public. We are publishing it here..The Stay List is at the end of this post.

This is what we are seeing from the Fund, they are paying claims. We have long advocated for the settlement, and they needed time to get all of the wheels on the bus, the wheels are on the bus. We are seeing a rhythm to the  claims process, claims are getting paid on a regular basis.

I wish I could say this is happening for everyone, but I can`t. I do believe that certain firms with credibility with the Fund are getting preferential treatment because they know that the Claims being presented are credible and have their documentation all together.

As a fact some firms are getting claims paid regularly, some are not, I think is based on the performance of those firms, and how they prepare BP Settlement Claims. The fact is some know what they are doing, and some just don`t have a clue, and that is recognized by the Fund. Now this is conjecture I am not a lawyer, but I know most of the players in this, and it`s just the way it is as I see it.

OPA Claims may still have Time to File

There is a possible exception on the OPA deadlines, which could give certain businesses some extra time to submit a claim – OPA states “3 years from the time people we aware of damages” with the oil spill occurring in 2010, time is of the essence.  Basically if you did not realize you were impacted by the Oil Spill till a year after the Oil Spill, the argument is you still have time to file under OPA, and some Attorneys are ready to make that argument.
To do this, they need to know when, why and how they realized you were financially impacted  (mainly focused on justification of “when”)
They need monthly P&L statements for the years of 2009, 2010, and 2011.

BP Settlement now has Stuctured Settlements

bp settlement Judge Barbier recently released an order that allowed for Structured Settlements within the BP Settlement.

Before being eligible for the Structured Settlement, your claim will have to be deemed eligible by the folks that run the DeepWater Horizon Settlement.

It seems that many people will benefit from this because they will be able to defer their taxes, for people and businesses that have very large claims, this could be very beneficial.

BP Settlement Claims begin to Stream in

The BP Settlement has begun to run on all cylinders recently. We have seen BP Settlement Claims begin to receive offers on a very consistent basis. Now I can only report what we, and  groups within our network  have experienced. What we have seen lately is all types of BP Settlement Claims are getting paid.

GCCF Claimants circle back to the BP Settlement

What we have also seen, is that many claimants have begun to circle back into the BP Settlement process that had given up after the GCCF debacle. Many times we can get their paperwork from the Settlement. The GCCF was a mess, it left people disheartened and disillusioned, the BP Settlement may have some issues, but it is far less arbitrary then it`s predecessor. Current Issues with the BP Settlement

  • Some claimants still have not seen any progress of their claims through the claims review steps, this is unfortunate, but we have seen the process just recently begin to speed up, and I mean very recently.
  • The customer mix test is still an obstacle for many businesses that are in Zone D, that don`t qualify under the standard V-Test model.
  • Naics codes are being rumored to change or BP has asked to set aside those claims in the building field, not sure how this is going to unfold, but we are keeping a close eye on this development, again let me reiterate these are rumors at this point.

BP Settlement News

The BP Settlement and Individual Claims

bp settlement  We have been in touch with Attorneys that have asked us to take over their individual claims, if the claims have merit, we will take them over. We think that individual claims have languished until lately in the BP Settlement. We have seen an influx of them get paid however, and that is something I think we are all happy to see. The claims are averaging between 1k-6k, not a lot but it is a start. We will be taking on these claims between 15-25% depending upon the level of work involved.

BP Business Claims and appeals

We have seen a variety of Business Claims get paid, some of them will be heading towards appeal as their  locations should have made them tourism based, but they were labeled non-tourism due to NAICS codes greatly impacting their awards. If you are finding that you need to appeal your claim, please don`t hesitate to call us and we will see what we can do. For many the ” Customer Mix Test ” is also coming into play more often and for many Business Claims it makes it about impossible to get through that final hurdle.

It is strongly recommended that when one starts their Business Claims for the BP Settlement they need to know exactly what they are up against and what type of scrutiny they will encounter under the terms of the DeepWater Horizon Settlement Agreement. We also think that instead of the Settlement Fund handing out incompleteness notices they furnish the claimants and claims preparers with one check list so that the claimant can figure out if they can even provide the documentation that is needed.

We are still seeing these claims get processed faster then any of the others, yes we did get an offer in less then 5 days recently, and it was subsequently paid in a matter of about 2 weeks.

Over the last several months we have been working on a system that would allow users to upload their own documents, about 2 weeks ago we initiated the system, and it has seen great success, it allows us to process your claims with more expedience, and it allows the individual or businesses to upload BP claims at their own pace. It has greatly increased the number of claims we are uploading to the DeepWater Horizon Settlement.
