With BP trying to mitigate damages by saying everything is back to normal economically, and they will not pay BP Claims for future loses, except in a few cases such as Oystermen, one can`t help but wonder what the future holds for the BP Claims process. The BP Claims process was supposed to make everything right as we endured the worst man made oil spill in history. Remember that it was BP`s negligence that caused the oil spill in the first place, and the BP Claims process was supposed to make it right, or at the very least, as right as it could be. What draws many people to the Gulf Coast is the natural beauty of the Gulf, the fresh seafood, and the splendor of spending a day in the blue waters of the Gulf of Mexico. By all accounts from fishermen, oystermen, shrimpers, and crabbers the Gulf`s health has issues. If the Gulf Health deteriorates as has been evidenced, will people want to come here to vacation, and that seems to be the only factor that BP is using when it speaks of taking future loses out of the BP Claims process.

If the Gulf of Mexico faces a catastrophic decline in marine populations, and there is some evidence of this already, what will happen to the tourists who have historically come to enjoy the seafood and bathe at the beautiful beaches. Three out of five people won`t eat Gulf Seafood. If it is not safe for the animals that call the Gulf home, are you really going to let your kids swim in the Gulf. BP  in a letter to Feinberg, is saying that Feinberg should not pay any BP claims for future loses because fisheries have reopened and the tourist season is back in full swing, as they cite hotel industry statistics, and news reports, reporting strong business backed by summertime tourism. The BP Claims process should not take into consideration future loses when factoring BP Claims. The remarks made by BP to Feinberg leave little doubt who is in charge of the BP Claims process. Just when you thought things could not get any worse at the GCCF, and their ability to treat BP Claims fairly

At the beginning of July, the GCCF had paid $4.5 billion in claims to 195,000 claimants. There are also about $430 million worth of offers that are under consideration by Gulf residents. Mind you that almost 600,000 BP Claims have been filed.

BP Claims Ploy or just Absolute Arrogance

Could this be just a ploy by BP to get people to accept the next batch of BP claims settlements. According to my calculations BP is about to pay the next round of BP Claims, remember they get founded with 1.2 Billion dollars every quarter. The last wave of claims we saw receive settlements was mid April, making mid July the next wave that should occur. When it occurs we will see a sudden jump in offers being made, many of these offers will be Interim Claims offers accompanied by Final Claim offers. The news seems to coincide with the next wave of BP Claims settlement offers, coincidence, I doubt it. BP and the GCCF have joint strategies and the biggest one is to settle the most amount of BP Claims, for the least amount of money, by BP telling the public that it wants to take future loses off the table, many people with valid BP Claims will be inclined to settle now.

The Arrogance of BP to even suggest that the Gulf Region is back to normal and exceeding pre spill numbers marks a new low in the BP Claims process. It is understandable that BP and the GCCF want people to believe that everything is alright after the Oil Spill, many business owners share the same sentiment. The fact however is everything is not all right, and according to various sources things could get a lot worse in time, neither BP or Gulf Coast Business owners want to hear this.

I just spent a week with Johnathan and Andy Hillstrand of the Time Bandit from the show Deadliest Catch, they are two dear friends that were in town for the Suncoast Offshore. They were instrumental in helping me launch previous charity sites that helped 1000`s of people connect with charities directly after the BP Oil Spill. They are quick to point out that the fishery in Prince William sound seemed normal for the first several years, then dramatically dropped, never to return to normal 20+ years later. Current estimates have the Herring population at about 15% of the pre spill population.  The latest indicators from the Gulf Fishery show a dramatic decline in the catch of brown shrimp, this has happened even faster then anticipated. The catch is down over 90% and fleets of shrimpers have halted fishing for them. This is the real truth, that many families are grappling with, as they try make a living in this once thriving industry, at the same time BP is putting everyone on notice that they don`t want to pay for future loses for BP Claims.

Time is needed for a more complete evaluation of the Health of the Gulf of Mexico, as we have learned from past oil spills, many of the effects from such a catastrophic oil spill won`t be known for years. For BP to make such sweeping statements that it will not be responsible for future losses incurred by Gulf residents at this early juncture, only furthers my belief that the true course is to move forward with BP Interim Claims only.

The GCCF`s new tactic to delay your BP Claims is called the Deficiency Notice. After speaking with 4 business owners last night, they ALL had just gotten deficiency notices for their BP Claims. The Business Owners had already provided the documents that the deficiency notice said were missing from their files. The documents were never missing from their files, but the GCCF said they were, and they could not process their  BP Claims. Again their BP Claims were delayed.

BP Claims Mislabeled

One of the individuals who owns a good size business decided to go down to his local GCCF office and talked to them directly about his BP Claims. He had spoken to this person before and she went through his file with him standing right there. After going through the file they found the documents the GCCF said were deficient. The documents were there, they were just mislabeled. His BP Claim was then sent to a Claims Review Specialist. The new Claims Review Specialist has given his claim a new number, and can now look up all the pages in his BP Claims to finally make a determination on his claim. He was told that he would have an answer shortly regarding his BP Claims.

BP Claims Pattern

After making four phone calls yesterday to follow up with people, they all had the same exact story about their BP Claims. Coincidence, I don`t think so. The GCCF is pulling out every tactic it can to delay your BP Claims. Mislabeling documents that have already been sent in might happen once in awhile by careless processor, but not four follow up  phone calls in a row. Has the GCCF  mislabeled BP Claims documents intentionally, only to buy more time and frustrate the people in the BP Claims process, I think so. This is just one more road block that the GCCF is using to frustrate and delay people from receiving their BP Claims money, and hoping they go away.

The Gulf Coast Claims Facility has sent out letters to many recently that their BP Claims are denied, or that the GCCF is requesting more documentation to substantiate your claim. Why, after months and months of processing is the GCCF doing this now.

It is all part of a larger tactic employed by the GCCF of Delay, Deny and Defend. The longer you wait for your BP Claims money the more people become disenchanted with the whole process. Many people decide not to take further action, or not to take any action at all. This is playing right into their hands. They want you to lose interest in the BP Claims process.

If their true intention was to make it right as their slogan says, the BP Claims process would be more streamlined and more fair. By making the process more difficult the GCCF is saving BP money. Lets remember that the GCCF is run by Ken Feinberg who is paid by BP. He is paid 1.3 million dollars per month to administer the BP Claims money through the GCCF. Feinberg tried desperately to portray himself as independent of BP, it took a ruling by Judge Barbier in New Orleans to tell him to stop saying he is Independent.

BP Claims Fund is paid Quarterly

The GCCF is allotted 1.2 Billion dollars from the 20 Billion dollar fund every fiscal quarter. That money goes to paying off as many small BP claims as possible, with a few large ones that are being represented by aggressive BP Claims Attorneys. Paying off the small claims first helps the GCCF look impressive statistically. Look at how they manipulated people into taking the BP Quick Pays. First they delayed paying anybody with Oil Spill Claims for sometime, promising people that Interim claims would be forth coming. Then after months of not paying those BP Claims they came out with the BP Quick Pay, 5k for individuals and 25k for business`s, this was only after people reached a high level of economic desperation. This also allowed them to take over 100,000 oil spill claims off the books, in a short amount of time, and people gave up their right to sue BP.

The BP Claims Shuffle

This is what the BP Claims process is coming down to, The GCCF is stalling because it does not have the full 20 Billion Dollars in the Bank, it is funded incrementally. When the money runs out, so does their ability to pay claims. What is the GCCF’s best line of defense? Your BP Claims are UNDER REVIEW, or your BP Claims have been Denied, please reapply.

None of this helps much when your world is in economic collapse due to the Oil Spill. Lately, BP has been making deals with its partners to pick up some of the cost. Weatherford International has agreed to pay BP $75 million, Mitsui has agreed to pay BP 1.1 Billion. BP still has ongoing suits against other Deepwater Horizon partners Transocean, Halliburton and Cameron International as part of the multidistrict litigation that is ongoing in the U.S. District Court for Eastern District of Louisiana.

With all of this money coming in and the energy BP is expending to bring it in, you would think that if they used half of this effort you would assuredly have gotten your BP Claims paid by now.
