BP Claims and Seafood Harvesters
We have been hearing form a large number of Seafood Harvesters that took Quick Pays for their BP Claims, many of you were told it was an Interim payment when you were met at the dock by members of the GCCF. As we have been writing about this over the last few days, we have been hearing from many of you, and it seems that a pattern is developing, you were often met at your docks, and many of you were told the Quick Pays were Interim payments.
It almost seems the GCCF was targeting you all, because they knew that your BP Claims would eventually have the most value. Even if you were not targeted in such a manner, it is obvious that they did target Seafood Harvesters, crabbers, shrimpers, oystermen, and fishermen, when it came time dole out the Quick Pays, preying on the people that were most affected by the Oil Spill.
BP Claims Interims turned to Quick Pays (a Little GCCF History Lesson)
If you all remember November 2010 when Mr. Feinberg took over we were all expecting people that were hurt by the Spill to start getting Interim BP Claims. What really happened was that they had another agenda and that was to get people to take BP Claims Quick Pays as the program was quickly rolled out by mid-December 2010, and NO or very few Interim Claims were being paid.
We did not even hear of an Interim Claim getting paid until mid April, and even after that they were few and far between. What does that mean, that means they had to have the Quick Pay Apparatus in play before Mr.Feinberg even took over the GCCF, they just didn`t tell us that part. Putting a BP Claims Quick Pay system in place takes more then a month, at least as far as I can tell, by judging the History that we can now look at called the BP Claims Process.
So all that being said from November through April, and even long after that, that is 6 months plus people were either starved out or forced to take Quick Pays and that NEEDS to be addressed in the BP Settlement. It wasn`t till early February 2011 that Feinberg couldn`t call himself independent anymore, it took a Judges Order to get him to stop, at the very least anyone who took Quick Pays during the time Feinberg was calling himself independent deserves a second shot. Over 200,000 people and businesses took Quick Pays, if the BP Claims process was processing Interim Claims as they promised this would not have happened.
They pulled a fast one on all of us, they promised Interim Claims and gave us Quick Pays, and it is my strong belief backed up by their own actions this was deliberate. This needs to be handled within the terms of the BP Settlement, or it needs to be handled by The Court.

BP Settlement: Insider says BP about to pay 30 Billion to settle BP Claims
BP Settlement Claims News: A BP insider reported to Reuters that BP may want to settle many its BP claims after the February trial date. The trial would solidify who was at fault for the Macondo well blow out. A recent report that was finished this week, put the blame squarely on BP`s shoulders. Halliburton and Transocean did share some of the responsibility, but due to the lack of oversight, cutting corners, and not releasing all the information to it`s partners, BP was ultimately responsible for the Gulf Disaster. report
My sources that are very involved with the litigation and the BP Claims process think that BP will make a large push to settle out as many claims as possible, before the February trial date. We are seeing BP Claims get paid at a record rate. By both Adjusters and Attorneys.
Your Claims value may have jumped exponentially
For Example: A Claim that was 7k may be worth 25k, this is because certain thresholds in the mass settlement will have to be reached. BP Claims that were 100k could conceivably go up to 300k or more. The exact formula has not yet been revealed, but sources close to the litigation, including an Attorney that we have been forwarding many of your claims to, has already uploaded all of their cases to the GCCF. There are multiple answers to this question.
1. The BP Claims process is about to be audited by Eric Holder at the urging of Jim Hood. In my opinion this will uncover what many of us already know. The GCCF under Feinberg was slow to pay and it preyed upon desperate people by not coming through with BP Claims interim payments in a timely manner, instead denying valid BP Claims, or giving already desperate people and Business`s Quick Pays.
In my opinion Quick Pays, having BP Claims Under review, denying valid BP Claims, where tactics that have been used as extortion to those hoping to get paid in a timely manner. I further think that though there are a lot of good people that work at the GCCF, that the top brass at the GCCF wanted to slow things down, and in fact did so. This will be revealed by the Audit, that is forthcoming and BP and the GCCF will be held accountable. Hence it pays for them to settle now before the full picture develops.
2. BP will want jurors to believe that they have indeed tried to make things right in the Gulf before the February trial date. A massive payout to claimants before the trial starts will boost the GCCF statistics and good will. The GCCF loves to point out positive statistics, the fact still remains that most of those that have been paid out have been paid out under the Quick Pay system.
3. BP needs some positive PR. The longer the events from the OIl Spill drags out, the more BP`s reputation and business practices get tarnished. If they decide to drag this out as more news comes to light surrounding how the oil spill was caused, and how people that people that were affected were largely ignored, by BP and the GCCF, it is my opinion that this could spur multiple lawsuits, mind you I am not a lawyer.
4. Mitigation, Mitigation, Mitigation, there is no good news lately for BP and they need to cut their losses, the best way for them to do so is to make some realistic offers and to get people to accept final settlements so people don`t go and sue them down the road. BP Claims punitive damages for those directly affected by the oil spill are now applicable. The forthcoming news for BP and the BP claims process is not going to be any good for BP and Gulf Coast Claims Facility.

BP Claims Process and Punitive Damages
Judge Barbier ruled that under Maritime Law, business`s and individuals that were affected by the BP Oil Spill could sue BP for punitive damages. This is a major blow to BP. Punitive damages go beyond just the economic loss incurred. They are intended to punish the offender, so it doesn`t happen again. Extreme negligence will have to be proven on BP`s part. Article
How will this affect the BP Claims Process
As of now punitive damages aren`t compensated for in the Oil Spill Claims process. What is taken into consideration is Interim Claims. It has always been my position that it is best just to file BP Claims for Interim Payments, unless you really need the money, and I know many people do. Interim BP Claims allow you to sue BP at a later date, and if it looks like punitive damages are going to be awarded, you may want to reserve your right to sue BP, therefore you may not want to take a final settlement for your BP Claims.

Attorneys for the Plaintiff`s also charge that the GCCF is not in compliance with the Oil Pollution Act, and that all the Quick Pays deserve a second shot at the BP Claims Fund.
Today GCCF Lawyers Defend their Handling of BP Claims
The Attorney for Ken Feinberg, David Pitofsky said in court filings that the BP Claims Funds accomplishments show that there is no need for court oversight. He went on to say that they are overseen by several committees in Congress and the Coast Guard. When asked about the BP Claims Quick Pays he said that “It can be a perfectly rational decision to accept an assured short-term payment over a possibly larger, but postponed long-term payment. He also said that “claimants are drawn by the immediate cash for their BP Claims.”

Louisiana Governor Bobby Jindal and Attorney General Buddy Caldwell wrote a memo criticizing Feinberg and said he was not complying with the Oil Pollution Act known as OPA.

If the Judge rules in favor of the Attorneys it could mean that people and business owners that accepted the Quick Pays could get a second chance to get what they deserve from the BP Claims Process.
