Gulf Coast Claims Facility a True Story

Gulf Coast Claims Facility: BP Claims Coalition is Formed

Gulf Coast Claims Facility

Gulf Coast Claims Facility Victims

We have been in meetings over the last two weeks with Attorneys at the forefront of the oil spill litigation. The Gulf Coast Claims Facility has helped unite a group of Oil Spill Attorneys, Claims Adjusters and Activists. In an effort to hold BP and the Gulf Coast Claims Facility accountable, a formidable coalition of  BP Claims Experts has been created.  For the last two weeks we have gotten together to share ideas and intelligence on the trends we are seeing with the Gulf Coast Claims Facility. For months we have told you about our BP Claims Team, well the Team just got a lot bigger, with one goal in mind, to get your BP Claims Paid.

Gulf Coast Claims Facility Trends

What we are seeing is the GCCF is still making it difficult for BP business claims to get paid, without the help of knowledgeable Oil Spill Claims Experts. They are still trying to stall claims, and offering Quick Pays even when the amount owed far surpasses the Gulf Coast Claims Facility offer. The GCCF is still utilizing a delay, deny, and defend strategy, and waiting clients out that desperately need the money to keep afloat. This tragic, yet successful strategy has resulted in many business owners settling for the 25k quick pay, or just giving up on the BP Claims process.

Gulf Coast Claims Facility a True Story

Gulf Coast Claims Facility

Gulf Coast Claims Facility

Last week I spoke to an individual who just could not wait any longer, he was a Marine Contractor and built docks along the Gulf Coast in Mobile. People were not building any new docks since the spill, he had filed a claim over 7 months ago. He had received an EAP from BP. He had given the Gulf Coast Claims Facility every document they asked for, he was told on several occasions his BP Claim was escalated and was told to be expecting a check soon. The Gulf Coast Claims Facility went on to say that his BP Claim had already gone to the accounting firm that was going to be cutting him his check. He was expecting an Interim payment with a final offer totaling around 120k. Instead they made him wait months only to offer him 25k, and he was forced to take it due to his economic situation. This is what we are trying to help people avoid.

Here is an email he wanted me to share with you all.

What can I say.  If you go to a Gulf Coast Claims Facility office and look on the door and all around they have (We are here to help you recover)  That is a lie.  It is now 8 months into 2011 and the Gulf Coast Claims Facility has done nothing to help me recover.  On Feb. 15th I filed an interim claim for what I thought was the 1st quarter of this year,  9 weeks later on April 21st I got a determination letter that offered me zero on the interim and they offered me the 25,000 quick final pay.  The quarter they determined was the last three month of 2010 which I had been sent an emergency advance payment in Sept.  that covered my losses for 2010 I have no problem with that.  So I filed another claim for the 2nd quarter on the 22nd of April 2011.  Today is July 31st 2011 and I still have no new determination letter even though the first letter expired on July 24th 2011.  I went into a claims office here in Mobile, Al on July 1st and filed a claim for the 3rd quarter at which time I was told that my claim had been passed along and was now at the accountants Price-Waterhouse,  that was a month ago now and still no word.

Prior to the spill I owned my own company as a marine contractor building Boathouse’s, Bulkheads, Piers, and Marina’s all along the Gulf Coast.  I had a consistent income of over 5,000 dollars per month.  After the Oil spill I have had zero income from my company.  All Building of Piers, Boathouse’s, Bulkheads and Marina’s Just stopped.  The pile driving companies that were giving me the work all went to work for BP or they also lost contracts thus affecting my company in a negative way.  I have been trying to find work ever since and the little bit that is coming back has not made it down to my company.  I find it to be a shame that Ken Feinburg gets paid every month and the people who work at the Gulf Coast Claims Facility all get paid every two weeks but the people like me who are the ones who have suffered this loss.  We can’t even get an answer as to when or if we will get recompensed at all.  I find that to be discriminatory towards the people and businesses here who have suffered a loss and I wonder why the Media and the government have failed in holding the Gulf Coast Claims Facility and BP to their promises.  These people get paid on a regular basis but those who’s livelihood has been taken away we have to wait and try to survive on nothing for many months at a time only to find out that the Gulf Coast Claims Facility can take as much time as they want even going beyond the 90 days they claim that it takes to review a claim and send a determination letter.  Can someone please give me an answer before I’m forced into bankruptcy?

He eventually took the 25k quick pay and the future still remains uncertain.

If you have been offered a BP Claims Quick Pay, and would like it reviewed at no charge (most Quick Pays are 3-7 times too low),  if you have yet to file a claim,  or your claim was denied or is stalled at the GCCF,  We can Help you.

If you need Help with the Gulf Coast Claims Facility we have BP Claims Experts that can and will help you.

Fees start at 15% of what is recovered, don`t be a victim twice.

Claims Adjusters and Attorneys are standing bye to help you with the Gulf Coast Claims Facility.

GCCF Delays and BP Claims

GCCF is still up to it`s Dirty Tricks

The GCCF most often stalls claims by mislabeling documents inside your claim, often people are given deficiency letters for documents the Gulf Coast Claims Facility already has. They have been doing this for some time.  The GCCF has also been making ridiculous Quick Pay offers to many businesses that suffered much more substantial losses. GCCF Denied Claims are also on the rise.

GCCF Stall Tactics

GCCF

GCCF Tactics

While the Gulf Coast Claims Facility and BP are supposed to be making everything right it also seems they are in the business of trying to frustrate people who have legitimate BP Claims, and hoping they will just go away. This is a tactic that is used by unscrupulous insurance companies and it does work. The GCCF often mislabels documents within their file for your claim, then you are given a letter of deficiency and many find themselves sending in the same paperwork they all ready have sent to cure the deficiency. The GCCF is also slow to process claims, they have a history of telling people that your claim has gone to the next level, and saying everything looks good for it, but when it goes up the chain, you are asked to wait for more determinations, we have also heard of GCCF Claims that have gone to the accounting department and claimants are told the check is forthcoming, only to get denied or asked for more information. For many it is like being a hamster in a wheel, running fast to go nowhere.

GCCF Quick Pays are Preying on the Desperate

The Gulf Coast Claims Facility has been making ridiculous offers for BP Business Claims, and the 25k offers that many are seeing from the GCCF are often just a fraction of what is owed to the claimants. One of our BP Claims Adjusters recently had an offered increased by over 1500%, that`s right 1500%, it was a battle with the GCCF, and it got paid. This is an important point, you need a firm that will FIGHT for your money, not let the GCCF tell them what you should be paid. If you have a received a Quick Pay offer members of the BP Claims Team will check it out at no charge, and tell you what you are actually owed.

The BP Claims Team is getting GCCF Claims Paid

Members of the Team are fighting for your BP Claims money and they are doing a great job. If the Gulf Coast Claims Facility makes you an offer, get it checked out , members of the Team will do it at no charge. If they can get you more they will, and they have. Many Claims are settled for 15% of what Team members receive for you from the GCCF. If your claim was denied or if you have not filed one we can help you.

GCCF Delays and BP Claims

BP Settlement: Claims may settle out for 30 Billion Quickly

BP Settlement: Insider says BP about to pay 30 Billion to settle BP Claims

BP Claims

BP Settlement Claims News: A BP insider reported to Reuters that BP may want to settle many its BP claims after the February trial date. The trial would solidify who was at fault for the Macondo well blow out. A recent report that was finished this week, put the blame squarely on BP`s shoulders. Halliburton and Transocean did share some of the responsibility, but due to the lack of oversight, cutting corners, and not releasing all the information to it`s partners, BP was ultimately responsible for the Gulf Disaster. report

My sources that are very involved with the litigation and the BP Claims process think that BP will make a large push to settle out as many claims as possible, before the February trial date. We are seeing BP Claims get paid at a record rate. By both Adjusters and Attorneys.

Your Claims value may have jumped exponentially

For Example: A Claim that was 7k may be worth 25k, this is because certain thresholds in the mass settlement will have to be reached. BP Claims that were 100k could conceivably go up to 300k or more. The exact formula has not yet been revealed, but sources close to the litigation, including an Attorney that we have been forwarding  many of your claims to, has already uploaded all of their cases to the GCCF. Why is this happening, Punitive Damages, people and businesses that were directly affected by the Oil Spill are able to receive extra money for their losses, and this scares the heck out of BP. Hence BP is getting ready to settle now.

Why will BP try to settle its BP Claims before the February trial date.

There are multiple answers to this question.

1. The BP Claims process is about to be audited by Eric Holder at the urging of Jim Hood. In my opinion this will uncover what many of us already know. The GCCF under Feinberg was slow to pay and it preyed upon desperate people by not coming through with BP Claims interim payments in a timely manner, instead denying valid  BP Claims, or giving already desperate people and Business`s Quick Pays.

In my opinion Quick Pays, having BP Claims Under review,  denying valid BP Claims, where tactics that have been used as extortion to those hoping to get paid in a timely manner. I further think that though there are a lot of good people that work at the GCCF, that the top brass at the GCCF wanted to slow things down, and in fact did so. This will be revealed by the Audit, that is forthcoming and BP and the GCCF will be held accountable. Hence it pays for them to settle now before the full picture develops.

2. BP will want jurors to believe that they have indeed tried to make things right in the Gulf before the February trial date. A massive payout to claimants before the trial starts will boost the GCCF statistics and good will. The GCCF loves to point out positive statistics, the fact still remains that most of those that have been paid out have been paid out under the Quick Pay system.

3. BP needs some positive PR. The longer the events from the OIl Spill drags out, the more BP`s reputation and business practices get tarnished. If they decide to drag this out as more news comes to light surrounding  how the oil spill was caused, and how people that people that were affected were largely ignored, by BP and the GCCF, it is my opinion that this could spur multiple lawsuits, mind you I am not a lawyer.

4. Mitigation, Mitigation, Mitigation, there is no good news lately for BP and they need to cut their losses,  the best way for them to do so is to make some realistic offers and to get people to accept final settlements so people don`t go and sue them down the road. BP Claims punitive damages for those directly affected by the oil spill are now applicable. The forthcoming news for BP  and the BP claims process is not going to be any good for BP and Gulf Coast Claims Facility.

GCCF May Revise Payment Guidelines

GCCF may reduce payment Formula

GCCF Claims Czar

Ken  Feinberg mentioned reducing his two-time formula in November on Tuesday. Some multipliers have been as much as a seven times 2010 damages. Citing a return to normalcy, as tourists are coming back, and things are improving in general, the GCCF may have to restructure the formulas it has been using for Oil Spill Claims. In November the GCCF will review and possibly revise the guidelines it uses for GCCF claims. He will be taking into account the input from environmental and economic experts regarding the effects of the Oil Spill.

GCCF Is paying Oil Spill Claims

What we are seeing now is that GCCF claims that have come through our site are getting paid, and that often the GCCF formulas don`t necessarily apply if your claim is explained to them by seasoned Oil Spill Claims Expert. We have seen an uptick in Oil Spill Claims getting paid, many of them within 45 days of being filed, or being refiled. The advent of BP Claims professionals who truly understand the Oil Spill Claims process has a lot to do with this. These Oil Spill Claims Experts understand the Claims process, they know what you need to bolster your claim, and they know how to explain it to the GCCF. Many have formed relationships with the  people at the Gulf Coast Claims Facility.

GCCF Claims

So what do you do if you have a GCCF claim and it hasn`t been filed yet, or it is still sitting at the Claims Facility. If you have tried handling it yourself and the Gulf Coast Claims Facility does not seem to be cooperating, find a professional, if you think you can handle it yourself, by all means do. People in the hospitality industry specifically waiters and waitresses have seen some success here. If you have a business claim, and you want to maximize what you are owed, fill out the form to the right. Business claims are best handled by professionals, that can explain your claim. BP Claims professionals receive from 15% to 33.3% if you need the help of an Attorney. They don`t get paid until you do. We are here to help you navigate the waters of the GCCF.

BP Claims Predation

BP Claims get Shortchanged

BP Claims Predation

After the devastating effects of the BP oil spill last year, the BP claims process was supposed to cure any financial ills of the individuals and businesses affected. The BP claims process is run by the Gulf Coast Claims Facility and Ken Feinberg, it has been sorely lacking when it comes to paying BP claims in a timely fashion. Many claimants are desperate, as their home are being foreclosed, and vehicles repossessed. Many claims that have been at the GCCF have been outrightly denied after jumping through many hoops and after giving the GCCF  all of the documentation needed. Many business owners and individuals have not received any money since the GCCF took over the BP Claims process from BP.

The BP Claims 25K quick pay

It seems as though that many businesses are being offered $25,000 when their loss is much more substantial. We have been receiving phone calls from business owners and individuals that filed their BP claims last year that still have not gotten paid. Recently however we have seen a number of offers made to these businesses in the amount of 25k. These were unsolicited offers by the GCCF, in one instance a Lodge owner on Grand Isle who has a large fishing camp, and was owed over $700,000 by the GCCF was made a settlement offer of 25K. He had been waiting for over six months to receive his oil spill claims money only to receive a 25K unsolicited offer from the GCCF and Mr. Feinberg. If he accepted the 25K offer, he would be giving up his right to sue BP for any future damages, his business was clearly affected by the BP oil spill as it catered strictly to fisherman and corporate retreats that would take place at the Louisiana Fish Camp. It is astonishing that BP and the GCCF have would make such a low offer to a business that was so clearly affected by the BP oil spill

The GCCF and the BP Claims Process

This week GCCF Claims got Paid

GCCF Claims Office

One of the Claims Professionals we work with received 14 offers on Friday alone, why, because they are very good at organizing and maximizing GCCF claims, or going into your claim while it is at the GCCF recalculating the claim and curing any deficiencies. They have a reputation at the GCCF for being spot on when it comes to their calculations, and not leaving any money on the table. There are true BP Claims professionals who know how to deal with the GCCF, and you can find them here.

GCCF Claims Professionals

There are organizations that have a handle on the BP Claims process, there are law firms, accounting groups, and claims adjusters that have all had success with the GCCF. Some are better with smaller individual claims, while others handle more complex business and personal claims. Sometimes your BP Claims are better off in the hands of an Attorney because of causation issues, and a myriad of other challenges the GCCF may bring up. There is a lot to be said about placing your claim with the right group from the beginning, that truly understands the GCCF and the process.

GCCF and BP Claims Preparation

The GCCF and BP Claims process has been difficult for many people, and many professionals to get a grasp on. The fact is the GCCF methodology, and the trending incorporated within in change on a regular basis. People and business`s are getting oil spill claims paid by the GCCF. Many claims are being held up, because they lack proper documentation, or have been improperly filed either by the GCCF, or by oil spill claimants. It is vital when preparing your GCCF claim that you give them exactly what they ask for, nothing more and nothing less, as it leads to confusion, and allows more room for error. If your BP Claims are not being paid in a timely fashion, and most are not, demand answers from the GCCF. If your BP Claim seems like it should be more, and the GCCF is not explaining it to your satisfaction, put it in the hands of a GCCF professional.

25k BP Claims Quick Pay is No Gift

BP Claims Quick Pay touted by the GCCF as a Gift

BP Claims Quick Pays

According to our BP Claims Experts more then 50% of the BP Claims Quick Pays calculate out to be substantially higher then the 25k settlement offer. It doesn`t matter if your losses are 50k or 500k and supported by BP Claims documentation. I can`t tell you how many people I have spoken to that regret taking the BP Claims Quick Pays. The GCCF is surging ahead these days making BP Claims Quick Pay offers to business`s owners in mass. Often they will tell you, you don`t have all your paperwork together, or your oil spill claim is deficient in some way. Often the GCCF will deny your BP Claims only to circle back to you, and offer you the Quick Pay, making it seem like a gift. Let me assure you, the GCCF BP Claims Quick Pay is not a gift.

BP Claims Audit is on it`s way

The GCCF is not handling the BP Claims process fairly and people know it. The Attorney General from Mississippi (Jim Hood) and the Attorney General (Eric Holder) for the United States is taking them to court to audit the BP Claims process. Mr. Hood tried to get the information from the GCCF but they kept stalling him, sound familiar. In a last resort two of the top Attorneys charged with protecting the Rights of the People are gearing up to do battle for the People. If BP and the GCCF were handling the BP Claims process correctly, this would not be necessary.

BP Claims Quick Pays may get a second chance

A group of Attorneys have filed papers with Judge Barbier in New Orleans asking that the Judge review the Quick Pay system, because they charge that they are illegal under OPA. They further charged that BP Claims Quick Pays were offered to people that were under duress, and forced to take the BP Claims Quick Pays. If the Judge rules in favor of the Attorneys it could mean that people and business owners that accepted the Quick Pays could get a second chance to get what they deserve from the BP Claims Process.

What to do about your BP Claims and Quick Pays

First don`t let them pressure you into accepting the BP Claims Quick Pay, understand that this is part of their strategy to buy you out of suing BP for future damages. You need to get a second opinion on your BP Claims settlement offer from the GCCF, whether it is a Quick Pay or a Final Settlement. We have teamed up with several groups  that will review your Claims Settlements at no charge, and if you have been offered a Quick Pay of 25k, they will only charge you for any any recovery above the 25k. There really are people out there that will help you with your BP Claims. Fees start at 15%, fill out the form to the right and start getting help with your BP Claims. Our Experts can also look at your oil spill claims while they are still a the  GCCF, if they are Under Review or have been Denied, there is help for your BP Claims.

BP Claims Process Faces Audit

Hood Sues Feinberg to gain access to BP Claims

BP Claims Hero Jim Hood

Jim Hood the Mississippi Attorney General resorted to the lawsuit because his efforts to gain access to the documents on Mississippi BP Claims have failed. U.S. Attorney General Eric Holder announced the audit a day earlier in a letter to Feinberg. These are two of the top Attorneys in the country demanding to audit the BP Claims process, why, because they feel it is unfair, and it is taking to long to get the people their BP Claims money.

BP wants you to file your BP Claims without an Attorney

If the U.S. Attorney General has had to get involved in the BP Claims Process, you can bet it is downhill for the GCCF. The company who does not want you to use a lawyer is now getting it with both barrels from two of the top Attorneys in the Country. The GCCF and Mr.Feinberg had an opportunity to hand over all the documents that Mr.Hood had asked for, instead they delayed, giving him some documents, but not the ones he really wanted. Does this sound familiar? It is going to be interesting when they audit these BP Claims. If the leading Attorneys in the country are gearing up for a full investigation of the BP Claims process, and BP doesn`t want you to use an Attorney when filing your BP Claims, you should certainly see some red flags in the BP Claims Process.

BP Claims Solutions and the Gulf Coast Claims Facility

BP Claims and Our BP Claims Dream Team

Get paid for Your BP Claims

The BP Claims process has best been understood by people that have studied the process, and are aware of what the proper calculations are to elicit a positive response from the Gulf Coast Claims Facility. The methodology behind how the GCCF calculates your BP Claims has been hard to understand for many, and it is tilted in their favor. When oil spill claims calculations have been done by members of our Dream Team, BP Claims are often 50% or more then if you did them the GCCF`s way. Many denied BP Claims have also gotten paid by our Gulf Coast Claims Team.  They will help you put together any paperwork that may be needed,  reorganize and maximize your BP Claims, all while it is still sitting with the GCCF.

BP Claims that have been Denied, Paid in 9 Days

If you have had your BP Claims Denied it very well could be a blessing in disguise. There are members of our Dream Team that specialize in BP Denied Claims. The good news is that most of your paperwork is already together, and sitting at the Gulf Coast Claims Facility. This allows members of our Team to analyze the documents while at the GCCF, and add any necessary documents, and go over your numbers once again. Often they will find that your calculations were off, and that BP owes you more then you originally thought. They have had denied BP Claims paid within 9 days. This is not typical, but it has been done.

Are your BP Claims Still Under Review or Awaiting Documents

Often BP Claims are under review for several reasons, sometimes they just haven`t gotten to them, but often they are lacking the proper paperwork, this is usually followed by a Deficiency Letter. Most often BP Claims that lack the necessary paperwork are denied by the GCCF. Members of our Team can access your paperwork while it is at the GCCF, fix whatever is wrong and speed up the BP Claims process. They will also keep you up to date regarding the status of your BP Claims.

BP Business Claims and Multiple BP Claims

Very often when members of the BP Claims Team begin to analyze your case, and find out more about you, and what revenue streams were affected by you or your business, they often find that you can make multiple BP Claims. These BP Claims need to be substantiated with various paperwork that they will help put together. BP Business Claims are often very complex, we have members on the team that are currently handling BP Claims in excess of 100 million dollars. There are no BP Claims to big or to small.

BP Claims Dream Team: How it Works and How Much

All members of the BP Claims Dream Team work on a contingency basis, they don`t get paid until you do. They are all at the apex in their respective fields.
