FORMS & GUIDELINES TO HESI FORMS BELOW
If you were paid by the Neutrals, answer No to Question 1a, No to Question 2 and Yes to Question 3 and print off to the side “Paid by Neutrals”. Do not answer any of the remaining questions. You must include a copy of your settlement documents from them with the Claim Form. Please check the section of the Claim Form that identifies your type of claim and provide the appropriate SWS form and all documentation requested in that section.
If you were an “excluded” category under DHECC, you are eligible to participate in the HESI Settlement. Answer No to Questions 1-5, Answer Yes to Question 6, Ignore Question 7. For Question 8, check Yes, IF you filed a short form joinder and made presentment to the Court during the DHECC settlement and you have the paperwork to prove it. If you do not have these documents, you are not eligible to file a claim. Excluded category claimants do NOT fill out any SWS forms but must include their Federal Income Taxes for 2009-2011, 2009-2011 Profit and Loss Statements if available, copy of Articles of Incorporation or Organization (businesses), copy of Driver’s License, Copy of Business License(s).
If you were denied because you Opted Out of the DHECC Settlement AND you filed a short form joinder and made presentment to the Court during the DHECC settlement and you have the paperwork to prove it, Answer Yes to Question 1a, No to 1b, Yes to 1c and then Yes to Question 8. Do not answer any of the other questions. This paperwork must go into your packet with the Claim Form. Complete any SWS forms required for your claim type.
If you Opted Out of DHECC AND you filed a short form joinder and made presentment to the Court during the DHECC settlement and you have the paperwork to prove it, Answer No to Questions 1-3, Yes, to Question 4 and Yes to Question 8. Do not answer any of the other questions. This paperwork must go into your packet with the Claim Form. Complete any SWS forms required for your claim type.
If you are a person that sustained personal property damage in excess of $500 as a result of the oil spill, but your claim “type” wasn’t recognized under the DECC Claim Types, Answer No to Questions 1-6, Answer Yes to Questions 7 and 8 IF you filed a short form joinder and made presentment to the Court during the DHECC settlement and you have the paperwork to prove it. This must be included with your Claim Form. You will also need to complete an SWS1.
If you have a valid and payable DHECC claim, the only FORM needed for representation engagement is the STATEMENT OF CLIENTS RIGHTS FORM.
If you received payment under GCCF and signed a release, you are NOT eligible to participate – do NOT complete a claim form.
If you were denied under DHECC for any reason other than a valid Opt-Out, you are NOT eligible to participate – do NOT complete a claim form.
If you withdrew your claim due to a Fraud, Waste and Abuse (FWA) Notice, you are NOT eligible to participate.

The HESI settlement is the final settlement for the BP oil spill in 2010. This settlement is for fisherman, and for individuals that worked on the water, as well as banks, insurance companies, and all other industries excluded from the BP Deep Horizon and other BP settlements. Please read the following information explaining the HESI settlement.
Lawyers fees capped at 25% like DHECC claims
They are using a Neutrals Model – the Allocation Neutral in this instance is Magistrate Judge Joseph C. Wilkinson Jr.The judge said he doesn’t expect many claim forms as the vast majority of Claimants had to have been awarded damages under DHECC to be eligible for punitive damages under HESI/TO.
If they didn’t file and get some kind of award under DHECC, they are not eligible to file a claim under this settlement unless they were one of the excluded categories under DHECC (e.g., insurance, real estate development, gaming, banks, defense, gas and oil but ONLY if they have oiled property or are a commercial fisherman) or they properly exercised their rights to Opt Out. Also, the Court record showed that each “frivolous” claim filed (by ineligible Claimants) does nothing but drive up administrative costs and reduces the overall pool of funds for the eligible claimants. This was highly discouraged in both documents.
One additional fisherman has also been added to this class that were not previously allowed in DHECC –
2 classes – New – $902M (punitive damages under Maritime Law for oiled real or personal property and the following categories of claims from the DHECC settlement- Coastal Real Prop, Wetlands Real Prop, Vessel Physical Damage, Seafood Comp (all types), Subsistence, Charterboat Operator BEL, Charterboat Crew IEL ) and Old – (other DHECC claims for specified BEL claims ONLY)
!!!Deadline for claims is Dec 15, 2016!!!
HESI claims will not be touched until after DHECC is closed out – no advance or interim payments are allowed
If denied under DHECC – will not be included in HESI
If early pay out and signed release and covenant not to sue – will not be included in HESI
If Opt Out and signed signed a release and covenant not to sue (Quick Pay) – they will not be included in HESI
No bodily injury or BP shareholder claims are allowed in HESI
They will not issue Notices for Incompleteness – whats in the DHECC file now is all that will be included
They will issue a determination letter (not an Eligibility Notice) and then straight to appeal if Claimant rejects offer
No claimant will receive more than $150K

Just Under 10,000 people received an email almost 700 responded. Those are fantastic results.
It covers a wide spectrum of ethnicity and incomes, it was a solid sample set.
But the numbers we hear are much different, and they definitely remind me of an Oil Spill when Barak Obama was our President, and Hillary Clinton voted for the Gulf of Mexico Energy Bill “after the bill passed,” BP obtained the fateful permit to drill that resulted in the deadly and costly tragedy.
I JUST think we all need to remember that right now.

Since we decided along time ago, basically day 1, this was not just going to be about the money for us, we decided it was time to tackle some other issues.
This is just the beginning.
So it was time to go in some new directions, and what could be more timely then these Presidential Elections.
Lets face it Obama did not do a stellar job of how he handled the oil spill, and many people still blame Hillary for a number of fatal flaws whether National or International in scope. With Wikileaks getting drowned out by locker room talk, we really need to reevaluate a few things.
But the Biggest Issue I have seen and heard about from others is the lack of impartiality from the Media outlets. We live in a FREE country, but that comes with consequences, and when big companies feel threatened, they put their advertising dollars in action, and support the news outlets that support their candidates.
For instance CNN has been nicknamed the Clinton News Network.
Is this really the America we want, and would campaign caps really help.
Now I am not saying I am pro Trump, but I am pro fairness, and after what I have seen with the outcomes for many regarding the BP Oil Spill, things need to be fixed, but that`s for another Blog.
I thought that we had a pretty good sample set as the victims of the oil spill has everyone from clean up workers to business owners, and those in between.
If you are experiencing Incomplete Notices regarding your BP Claims, don`t worry. Traditionally there are a multiple ways to cure them. If you have a business claim it can be quite intricate, Individual claims are usually more cut and dry.
Incomplete notices for Business claims can be greatly impacted by rule 495. If answered incorrectly 495 can tank a business claim.

Please note that this is a sliding scale contract. What this means is the % of your recovery, if any, will depend on the amount of work that needs to be done.
The fee % charge could be as low as 10%; if you still have work that needs to be done or notices that must be responded to, the fee % charge could be as high as 20%.
There is no way for us to know until you are signed up, and we can actually view your documents in the DHECC portal.
Even if you have received an FWA or HUB Investigation Notice, we can still take your claim. If you know you have provided honest and complete documentation to the Claims Administrator, then members of our Network are open to taking your case.

Has your your claim taken far longer then other people you know? Has an attorney or processor told you that they had to refile your claim, many don`t. As I am writing this I have just received several calls from claimants who after checking their claim status themselves, realized their claims were refiled without their knowledge.
To check your claim click here, you will need your claimant ID and the last four digits of your ein or social security number.
Why did this happen, usually because processors/attorneys did not respond in a timely manner to incomplete notices for your claims. For many BP Claims Processors, processing came to a halt by some, when BP stopped paying claims, the issue here is Deep Water never stopped processing the claims. So if your claim was filed several years ago, you may want to check for yourself, which we highly encourage. Many Processors quite frankly were starved out by BP`s intentional shutdown of payments.
What essentially happens is, your claims if they were refiled send you to the back of the line. If your processors/attorneys/cpa`s were not forthright enough to tell you that your claim has languished for so long by Claims Processors shutting down their processing due to a lack of financial resources, shame on them, but your not stuck with them. Also please keep in mind this is by no means a fast process, and many BP Claims have just simply languished.
You are NOT STUCK with your Claims Preparation Group.
If you are a Claims Preparation Group and that includes Attorneys, that needs help processing your claims call us, we will help you if we can.
We have a large network of very well funded Attorneys and other Processors that can assist you. I know BP starved many processsors out, and as far as I can tell some claims processors are still not seeing many claims paid.
On the other hand I am happy to say through our network and our own internal processing we have seen almost 10 million dollars in paid BP claims in the last coupe of months.
We are seeing lots of appeals, pretty much anything over 250k is getting appealed, but we are seeing them won. It usually tacks on another 3 months to process.

New Home Builders BP Claims are seeing Better then expected returns, it was thought that 495 was going to impact these claims in a very negative manner but that has not been the case. Home Builders are walking away from the BP Claims process with some staggering amounts.
Deep Water on the processing side, has begun to have lots of issues with processing. We have seen this before around other deadlines, it is no surprise.
Here are some notes from Melody Scott about recent incidents regarding the processing of the claims we handle internally.
This is one of our very recent Internal memos.
Now advising that claims should be filed immediately and warning that the Deep Water system may overload or crash starting next week and this will not be an acceptable excuse for not being able to file a claim in a timely manner.
Now advising that their system resources are strained and upload times are greatly increased. Large documents must be broken up into smaller documents or they will not load.
BP Claims once forgotten are coming back to the table
We have been preaching this from the rooftops for a few posts now, there are many claims that NEVER entered the Deep Water Horizon Settlement from the GCCF. If you recall there were almost a million claims in the GCCF when it transitioned over to the Deep Water Horzion Settlement. When that occurred many people and business`s lost track of the necessary paperwork to transition their claim over, at the same time many never thought they had to do anything at all, and the claim would just naturally progress over there. They didn`t, and in our estimation we think that number is in the 100,000`s.
So over the last week we have been calling people that came in through our websites in 2010 and 2011, and what we are finding is that many people think they are filed but only have the old GCCF claim numbers and you got it, never transitioned over to the Deep Water Horizon Settlement.
Many had Attorneys and Processors that they never heard from again. I have heard one processor that dropped over 900 individual claims, when the transition over to Deep Water occurred.
BP`s playbook from day one has been Delay, Deny, and Defend, throw in a touch of greed and personal agendas by certain processors and attorneys, and the BP Claims process becomes even more muddled.
If you had a claim during the GCCF era and DID NOT take a Quick Pay, or a final offer, your paperwork is still in their database and very easy to revive, but time is clearly running out.
After all of the Damage BP has caused to Families and Businesses along our coast, I urge people to call the Deep Water Horizon Settlement Directly at 1-866-992-6174 and file if you can, or enlist the services of a Processor or Attorney. Have your financials in order and that includes your taxes and monthly pnl`s file your claim yourself if necessary, and preserve your rights, you can always move your claim over to an Attorney or a processor after the June 8th date.

If all or a good part of your paperwork is in the portal, filing or moving a claim is easier then you think. It all depends upon the quality of the data you have given them.
Since 495 has come into play it is actually very advantageous to have the original data that many of you provided to the GCCF or early Deep Water Horizon Settlement. If your financial data is held in accounting software such as Quicken or Quick Books and has been since 2009 or before, or you have an in house bookkeeper or the same CPA, you may be able to get your information in on time, but NOW is the time.
