Polar Opposites: David Duval compared with Judge Edith Clement
This morning I saw the second Freeh Report, which basically highlighted David Duval`s departure from the Deepwater Horizon Settlement.
It seems to me that the only chink in Mr. Duval’s armor was an email that he sent to his cousin regarding a panelists comments. Neither Mr. Duval or his cousin had any sort of monetary gain at stake from sending it, or reading it.
As the report noted, Mr. Duval was forthright immediately. As I understand it, he actually told the DWHS Leadership, and I will repeat this again, he had no financial gain whatsoever in sending this email to his cousin who is also an attorney.
He immediately resigned, as sending the email was contrary to an agreement that he had with the leadership of the Deepwater Horizon Settlement regarding confidentiality, and he wanted to avoid any hint of impropriety.
Now lets Compare Judge Clement’s Actions to David Duval’s
Let’s compare what happened to David Duval and how he dealt with it, versus what is going on with Judge Clement and her relationships with Big Oil.

Based out of Bozeman, Montana, FREE is a prime engine for free market environmentalism in the area of education.
The chairman, John Baden (a past member of the National Petroleum Council), preaches reliance on market mechanisms and private property rights, rather than on environmental law, for protection of the environment. Baden stresses decentralization – a shift of control from what he calls “Green platonic despots in D.C.” to “local interests.”
In reference to the agenda of FREE, Baden has written that it’s, “the norm among progressive, intellectually honest and successful environmentalists.”
One of the newest FREE plans is the “Charter Forest” project, in which national forests would no longer operate under the “multiple use” standard. Instead, each forest would be managed by whomever could make the greatest profit from it.
FREE has been offering all expense-paid trips to seminars for federal judges.
These seminars which feature such topics as “The Environment: A CEO’s Perspective” are usually held at private ranches or resorts in Montana with a plethora of amenities for the judges to enjoy. In the late 90’s, FREE bragged that nearly 1/3 of the federal judiciary had either attended or was seeking to attend one of their seminars.

GreenPeace reported that FREE received $430,000 from Koch foundations 2005-2011 [Total Koch foundation grants 1997-2011: $1,525,000].
Peter Geddes, Executive Vice President of FREE, has advocated against taking action on climate change because warming is “inevitable” and expensive to address. In addition, FREE sponsors seminars for federal judges that have been criticized for creating judicial conflicts of interest.
It gets BETTER – guess who The Koch brothers do Business with, BP of course.
The Koch Brothers even pollute the environment with BP, just ask the residents on the East Side of Chicago. This was recently documented by the Huffington Post. Here is the article.
So Judge Clement who is a board member of FREE, who takes large donations from the Koch Brothers, who work with BP, and both pollute the environment.
It is Very Very Clear that Judge Clement has a conflict of interest here, she should not be in any way associated with BP. Yet the Companies who fund her organization work closely with BP.

In essence they are for deregulation of the Energy and Oil Industrial sector, but they do have a few noble endeavors towards helping wildlife, but don`t let that fool you. This is an organization with a lot of influence that works for Big Oil and their interests.
It is funded by Exxon/Mobil, the Koch Brothers,Texaco, Exxon, General Electric, Monsanto, and Shell. They are the major players in the Oil and Gas Industry.
Judge Clement has a relationship with an organization which she has been asked to step down from by Committee on Codes of Conduct of the Judicial Conference of the United Stated District Court other judges have stepped down from FREE, so that there would not be a conflict of interest. Judge Clement still participates in FREE as a board member
Judge Clement appears to have a long-standing relationship with Big Oil she was appointed to the bench by George W. Bush and we all know he loved big oil. Bush signed the most sweeping bill to deregulate oil in 2005. Judge Clement was assigned to the 5th Circuit in 2001. Do you think that George Bush had an agenda to advance Big Oils interests, YOU BET HE DID.
If you look at Judge Clement’s stock portfolio you will notice that many of her mutual funds have energy stocks within them, she had interest in BP stock until 2009 or so.
If you compare David Duval`s actions and voluntarily resigning, versus Judge Clement’s refusal to recuse herself after a relationship with FREE. They are polar opposite in terms of integrity.
It is clear that Mr Duval has taken the high road while Judge Clement stands firm with Big Oil, and this has negatively impacted the BP Claims Settlement, either by her own ideology which is why Bush appointed her, or because of her relationship with Big Oil or a combination there of.
It is very clear what her next move should be, and it is not hearing the next appeal, but to step down from FREE, and correct any public perception of impropriety .

After the oil leaked into the ocean, it did not take long for it to reach the shores. The fragile marshland near the mouth of the Mississippi river was heavily covered by oil a few weeks after the spill. Soon after, the entire Gulf felt the effects of the oil spill. Dead animals of the sea and the birds were washed ashore. Some animals and birds were alive but covered in oil. The damage to the environment and marine life was extensive.
All fishing activity within a certain radius came to a halt. There was no way anyone could fish in such murky and grossly polluted waters. It did not take long for the environmental management body to put a restriction on fishing and soon after, extend it due to the magnitude of the oil spill before it was contained temporarily.

My name is John I am an Oyster Harvester of the Apalachicola Bay,for 30yrs now.I have surely seen better days out on the water since the BP oil spill and BP oil dispersant.
My father died in the Apalachicola Bay,so I feel a special connection to him being out there.It hurts me so seeing how much things have changed since the BP oil spill and oil dispersant.
This past year has been by far one of the worst and hardest oyster harvesting years.Being an Oyster Harvester for 30 yrs now,I know every oyster bed from Alligator Point to Indian Pass.I can take you personally to any one of them and show you first hand the effects the BP oil spill and BP oil dispersant have caused.
The state oyster beds that did produce have severely been worked down by so many oyster harvesters having to work only in the beds that did produce.Has this hurt our providing for our families, ABSOLUTELY! The oyster catch went from 30 to 40 bags in a day to 12 bags on a good day.Oyster sales are down due to the BP oil spill.
The first year,2010, BP made out like the BP oil spill and clean up would only last a year.That lead to the Quick Pay claim or pay-off.Yeah, BP gave you an option all right,take the Quick Pay claim or risk getting nothing.
Here it is 2yrs later and because of the BP oil spill and dispersant,the life for a Oyster Harvester is getting worse not better.Not only did the BP oil spill hurt the Oyster Harvesters,so has the BP oil dispersant.
It is in our bay,The Apalachicola Bay and BP is so responsible for it and our losses.Loss of income or lack of,reduce in production due to the catch of oysters per bags caught in a day.Also the limits set by Oyster dealers because of low oyster sales.
I took the Quick Pay and put that money into my oyster business counting on BP to do as they promised.My business has suffered greatly.I have had to sell to other oyster dealers not being able to have a sales route myself because of lack of catch and sales of oyster.Sales have been drastically reduced due to the BP oil spill having affected the Apalachicola Bay. Now I don`t qualify for the BP Settlement my last chance at being made right.
A family simply can not survive off this way of living anymore because of the BP oil spill and BP oil dispersant.
Who will help this starving way of life and living now?Who will make this better for the Oyster Harvester and other fishermen of The Apalachicola Bay and The Forgotten Coast Line?
My husband had invested much of his life to commercial fishing, always investing our hard earnings back into our business to have a nice home, to send our children to better schools, and school functions is a must with my husband, and I. We owe our lives to the Gulf of Mexico with its plentiful oysters, shrimp, and crabs to live upon, and to sell to our community consumers. My husband served our country as a Marine for four years, but that was years ago. I just want to let you know what a great husband and father he is, as well as a great person he his to our community, and state.
He was on the water about to go fish for crabs, but with so much stress that came with the BP oil spill he had a stroke on his sons birth date Aaron 3/16/1990. His blood pressure was 265 over 110 My husband stayed in Tulane medical centers ICU for 3 nights, and on the ground floor for 2 nights. The Doctor Mrs. Martin said it was acute stroke, saying it was “acute” meaning very bad. We are now in speech therapy, and taking the steps for him to get better.
BP or the press needs to know how they are making the commercial fishermen starve to take the $25,000.00. BP has our paper work, and the information needed to at least give us an intern payment, but never.
The BP assistant (rep) said in 2010 the oyster grounds were open. I say BULL, I have the paper clipping on that year, and lets not forget our oyster vessel could not work, due to the closure. BP must know with a 50ft oyster vessel, crab vessel with 400 traps are not just for there looks. Why would BP ever have a question about the payment if our family has these vessels in our own back yard?
Our family are now on food stamps, and getting little help from the church. I now have a $85,000.00 dollar hospital bill, and bills from his MRI, and other tests that the hospital ran to make sure he had no bleeding in his brain. He has lost more then the BP Settlement could every pay us now. Shame on you. We own a 50 foot oyster vessel, crab vessel with about 400 trips that we live on to pay our bills, but the spill has made the waters baron with no seafood to support our families living.
Can you see now how my husband had his stroke? I will call it a BP stroke! We never called an attorney yet, because we thought that would hold up any payment we might have received, but this is my husband! How can you do this to a family? Oh, and never mind about the main issue of people working at Popeye’s that receive money. Where are their vessels?
A very upset wife of a fishermen. I would like to ask whom ever is reading this if their loved one had a stroke? Well, let me tell you that the person whom had the stroke is not the same anymore. He can’t talk, he can’t think, he lost his humor. Very sad indeed.
I see the loss amount you would like me to give you, BP has taken my life, my husband, and a father away from me and my family. It would be hard to tell you how much of a loss this was. The hospital in itself is $85,000.00 and counting. To get my husband back to whom he was, priceless. I’m a very nice women, but this is the result of stress from the BP oil spill. Our total loss is $350,000.00 and counting.
We will Never give up Helping these people and others affected by the Oil Spill, for us it is personal and we are here for the Duration.

Oil Spill Clean Up
As many of you know we follow Oil Spill Clean Up Workers and the challenges they face. I received a phone call last week from a knowledgeable lady who gave us all kinds of great information about testing for Corexit and other Oil Spill toxins in your Blood. In speaking with clinicians this morning at a variety of locations I kept hearing the same thing. Those who were tested, all had dangerous levels of toxins in their bodies, and some were well above FDA guidelines. My experience with Corexit
From the very beginning of this project I have felt most drawn to helping BP Oil Spill Clean Up Workers. I was out on Grand Isle in June 2010 and the smell of Corexit filled the air, within hours I was coughing. In my infinite wisdom I picked up a piece of Corexit in my hand, I had it on the tip of my finger when it broke like an egg, and it suddenly covered my hand, seconds later my hand was burning, and when I tried to wipe it off, I only proceeded to spread it up my arm. A nice lady on the boat had baby wipes that removed it, regular towels were useless. The way the Corexit bonded with Oil and coagulated it created something that resembled the texture of the yolk of an egg. but more firm, until it broke then it was a gooey mess.
Clean up Workers & Corexit
Cleanup workers were ill equipped to handle the oil spill from the very beginning, lacking both basic equipment and the knowledge of just what they were dealing with. Corexit poses health risks at the molecular level. Corexit bio-accumulates in one`s body. The lungs, kidneys and liver are most affected, and it does cause cancer.
This is from Wikipedia: Mind you, this is about Corexit 9527 not 9500, less is known about the after effects of 9500 on Humans.
Corexit 9527, considered by the EPA to be an acute health hazard, is stated by its manufacturer to be potentially harmful to red blood cells, the kidneys and the liver, and may irritate eyes and skin. The chemical 2-butoxyethanol, found in Corexit 9527, was identified as having caused lasting health problems in workers involved in the cleanup of the Exxon Valdez oil spill. According to the Alaska Community Action on Toxics, the use of Corexit during the Exxon Valdez oil spill caused people “respiratory, nervous system, liver, kidney and blood disorders”. Like 9527, 9500 can cause hemolosys (rupture of blood cells) and may also cause internal bleeding.
