Get the money you deserve, file your BP claim today
Since the recent court rulings, we are now seeing BP claims paying again. About a month after the decision made by the Fifth Circuit Court ordering BP to resume payments, we began to see a regular flow in the way of notices and some payments.
Keep in mind, all claims that were not paid prior to the halt in payments that was ordered in late 2013 have to be recalculated to determine if they are going to be subject to Policy 495 (which involves matching and smoothing financial statements to avoid showing an overstated loss).
If the company has financial statements showing a revenue trend making it subject to 495, the claim will be recalculated according to the new Policy.
This means that an earlier estimate you received may change, and you may have to wait a little longer to receive your claim.
We are now seeing Zone A businesses and individual claims paying at this time.
It appears the focus is on claims from the 3rd and 4th quarter of 2013.
We have also been told that medical claims are now paying out, but only the smaller ones, claims of around $1,300.00.
One of the huge problems we are starting to see is that people may have a claim filed, but they have not heard anything from the claims office or attorney they filed with.
While it is not unusual for a claim to take a couple of years to pay out, not hearing ANYTHING may indicate a problem.
We have discovered that some of the firms have abandoned their clients, and many of those claims have been denied. Some of these clients were never notified.
Don’t worry, it is fixable.
1-800-BPCLAIM is still filing claims, since there is not an official effective date, there is not an official deadline. After the effective date is set, claims can still be filed for six months past the effective date.
Here are some of the problems we have been seeing with clients from other firms:
– Claimants have incomplete notices that have not been cured
– Claims have been denied without the claimant’s knowledge
– Many claimants discover they have to start over in the claims process

BP Medical Settlement Update
Immediately after the oil spill occurred in the Gulf of Mexico in 2010, efforts were made by BP to begin the cleanup process along beaches and shorelines. A sea-floor oil gusher continued to spew crude oil into the Gulf for 87 days until the leak was capped. In total, 210 million gallons of oil were dumped into the ocean due to BP’s negligence.
90,000 workers and over 7,000 vessels were assembled throughout the Gulf regions to begin containing, dispersing and removing the remaining oil and tar deposits in the summer of 2010.
The clean-up efforts utilized 1.84 million gallons of the dispersant COREXIT, which acted to emulsify oil deposits that would normally rise to the surface, leaving them suspended in the water and on the ocean floor. Many of those working on the spill did so without gloves, masks or any form of protection from the hazardous substances to which they were exposed.
A study performed in 2012 by the Georgia Institute of Technology later revealed that when COREXIT mixes with oil, it becomes 52-times more toxic.
COREXIT is banned in several European countries because it does not pass their laboratory toxicity tests and they feel it is unsafe for human exposure. The composition of COREXIT contains hazardous chemicals which are known carcinogens. If exposed, other chemicals which compose the dispersant can cause damage to red blood cells, the kidneys and the liver. Internal bleeding, blindness, and the buildup of chemicals in the flesh have also been witnessed. Some severe cases of exposure have led to death and many other debilitating conditions.
After only 3 years out from the spill, the long-term effects of exposure to crude oil and other dangerous dispersants are yet to be seen. To assist those who were exposed and became ill, BP created the BP Medical Settlement.
Current Status of the BP Medical Settlement
On January 11th 2013, the United States District Court in New Orleans granted final approval of the Medical Benefits Class Action Settlement Agreement. However, because two appeals were made to the settlement in February, no claims are being reviewed or paid out. In July, one of the appeals was dropped, but one is still being contested. Until this appeal is resolved affected individuals will not receive any financial or medical help from BP. The only move that has been made thus far is the Gulf Study, a research program sponsored by the US Government and BP to monitor the environment and individual health of those that were exposed to the oil and chemicals.
Why aren`t BP Medical Claims getting Paid
The remaining appeal was filed by Darrell Palmer, an Attorney from California with four clients out of Florida who suffered from exposure to the harsh chemicals. The Plaintiffs Steering Committee asked that a $50,000 bond be placed on Palmer which he would be forced to pay to continue the appeal. The judge placed that bond and Lawyer Theodore Frank paid it for Palmer and will continue the appeal in his place.
If the appeal is lifted, the BP Medical Settlement will have to start reviewing claims and paying the affected individuals. Some claimants can expect to receive up to $60,700 for damages they suffered. The conditions of the settlement would also allow them the right to litigate at a later date should any further spill-related medical conditions arise. Unfortunately at the moment though, all of this is at a standstill until the appeal on the settlement has been lifted.
People have become very sick from exposure to these carcinogenic chemicals, yet medical claims are not being paid. Many are out of work because of conditions imposed upon them by their past as a cleanup worker. Although the economy was highly affected by the spill, it seems as if people’s health is much more important than compensating a business for lost revenue.

It has been a week since the DeepWater Horizon Settlement has officially begun. What can we say except we told you this was going to be a mess, and it is.

Lets remember they are just getting this ramped up, but the overall consensus is that this settlement will not last. There will be too many people opting out, too many law firms not opting their case loads in, and if you follow the pyramid example, the DeepWater Horizon Settlement is just one more mechanism to get claims settled.
The big question is will they settle out the larger claims, if they do, the DeepWater Horizon Settlement has a chance of making it, if they wait these claims out, to when the deadlines come up, it will most likely fail.

BP Settlement Breaking News
Judge Barbier heard from Plaintiffs Lawyers and BP Lawyers why the BP Settlement should be approved yesterday, it is highly likely that preliminary approval will be granted. That is good news for many people and businesses that still have BP Claims that have languished at the GCCF.

Jim Hood went up to bat for the people that took Quick Pays, over 200,000 people should have a second shot at BP he explained, many of them signed off due to economic duress. We all know that BP and the GCCF preyed on these people and many of them were the hardest hit by the Oil Spill the Shrimpers, Crabbers and Oystermen. They seemed to have targeted these groups from the beginning.

These people should be made whole under the BP Settlement. We had spoken to one of his aides just days before, they are taking this issue to task.
BP Settlement: Charter Fishermen and Processors
Attorneys argued that Shrimp processors needed to have a better RTP rate then a common business claim under the BP Settlement, this is pretty much a no brainer. They are directly tied to the health of the shrimping industry, this had to be had to be some sort of oversight.
In fact any Seafood processor whose down stream was affected by the Oil Spill should be given the same RTP`s as the people who supply them when they are so dramatically tied to the Health of the Gulf. This should also apply to Charter Boat Captains and anyone that makes a living from the Gulfs bounty or the lack there of and should be covered in the BP Settlement.

This is very exciting news as we are being given the opportunity to more fully understand how the BP Settlement process is going to work, and how it will fully benefit the people that come through our site, and desire to become a part of the BP Claims Settlement Process. The nice difference here is we are actually being asked for some input regarding the BP Settlement under the new leadership, unlike the GCCF. The BP Claims Settlement will be an opt in or opt out process.
Becoming a part of the BP Settlement

The GCCF and the BP Claims Transition
We are hearing that a lot of BP Claims are being denied for causation issues, and others are not receiving any future trending considerations under the BP Claims Settlement transition. Many of our claimants are electing to be a part of the BP Settlement, and have asked that we wait before sending in their paperwork.
BP Claims Settlement Eligibility
So, who can file BP claims in the Settlement, the information below is subject to change. There are a number of common factors shared by Business and Individual BP claims. They are the following:
– Any Individual/ Business that are eligible class members AND suffered an economic loss
can submit a claim.
– Eligible BP claims class members will be subject to several different types of specific
– These BP claims methodologies will take into account such factors as type of
business/employment, geographic location and the nature of economic loss sustained.
– Upon determining these factors, a loss will be calculated and a specific RTP will be
applied to each type of claim.
Geographic factors for you BP claims will be divided into four zones. Causation will be applied depending on the locale your BP claims are based, or where your loss occurred, where your business or employer is located. More factors are applied by the new BP claims system, but the positive side of this is that more people will get paid more money. Your BP claims award amounts will be more significant under the new BP claims system. The zones will most likely be applied in this manner:
– Zone 1: Will be most likely within 0,5 miles from the beaches of the entire Gulf Region,
from Key West to Galveston, TX.
– Zone 2: Not on the beach, but within 0.5 miles from the beach. Your BP claims will depend
upon these scenarios:
– Zone 2-A: You are a business or individual whose business or employer relies
directly upon the two Gulf resources, tourism and/or seafood. If you are a business, or
employed by a business that relies upon both resources, then chances are, your RTP
will tick-up, increasing the value of your BP claim.
– Zone 2-B: You area business not on the beach, not traditionally reliant upon tourism
or seafood. Perhaps you are a car dealership, real estate agent or catering services.
Causation will be your main issue, but at least you will not be denied so readily. If
you can say that you lost business because of the Spill, that you had cancellations
because of the Spill, can you document it? We can help you with the evidentiary
requirements for your BP Settlement claim.
– Zone 3: You are none of the pre-determinately denied business types within a mile from
the beaches, or coastline. Causation will be an issue for your BP claim. If you can claim
that your losses were caused by cancellations, lack of business, can you document it? Just
because you say it does not make it true. You must prove it. Causation did not disappear
with the new BP claims system.
– Zone 4: You are over a mile from the coast line. You must show a dependency upon the
Gulf Resources of seafood and/or tourism and must be able to document it.
BP Settlement Claims for Seafood Harvesters
A BP claim for economic loss available to commercial fishermen, crabbers, oyster harvesters and leaseholders will be a separate BP claim. BP has set aside $2.3 Billion to fund commercial fisherman BP claims. This particular fund excludes the processors of seafood, but it looks like it will include all the fishermen of the Gulf Region from Texas to Key West. BP Settlement Claims will cover the following types of commercial fishing industry business, or employment types:
– Vessel owners.
– Deckhands and crew.
These BP claimants must be able to prove that they fish in the Gulf or within specified Gulf waters.
BP Property Claims
1. Coastal Real Property Damage Claims: This class of BP Claim includes owners and
lessees of real, coastal property, boat slips and privately owned docks owned during the
time of the Spill from 4/20/10 through 12/31/10. The property must be within defined
geographical regions, or inside areas that were touched by oil.
2. Wetlands Real Property Damage: This is a new category of BP claims. The GCCF was
not inclined to pay BP claims for wetland owners because BP was reluctant to pay, in
the first place. The same standard of ownership time will apply to this BP claim. The
property must have been owned on 4/20/10 through 12/31/10, at the very least.
3. Real Property Sales: For the BP Settlement Claim program, for your BP claims, you must
have owned the property on 4/20/10 and the sale MUST HAVE occurred on, or after,
4/21/10 through 12/31/10. You must have suffered a loss on the sale, or below appraisal
4. A New Potential Class: People With Reduced Property Values After the Spill: In the BP
Claim Settlement negotiations process, there has been some mention and support that
property owners, who owned their property on and after 4/20/10, would be able to recoup
property value loss from 4/21/10 through 12/31/10.
BP Claims Settlement (Medical)
BP claims regarding BP medical claims under the BP Settlement system will be divided into three categories of qualification:
1. Clean Up Workers: These BP claimants have been previously and consistently denied by
the GCCF. However, the fact that many of the individuals who participated in the Clean
Up Project have been harmed by exposure to Corexit and oil is now beginning to surface.
2. Some Zone-A Residents: The BP Settlement will regard these BP claims to qualify if
they are approximately on-half mile of the beach, or coastal areas. These are areas with
sandy beaches or firm shoreline. These BP claimants must have resided on the coast for at
least 60 days from 4/20/10 to 12/31/10. Currently, the BP Settlement will include Zone-A
residents from Grand Isle, LA to the Florida Panhandle.
3. Zone-B Residents: The BP Settlement will include Zone-B Residents to be those who
Reside near the beaches, greater than one-half mile, but within one mile. These potential
BP claims can also include residents of the wetland areas and residents from Grand Isle to
