BP Medical Settlement Update
Immediately after the oil spill occurred in the Gulf of Mexico in 2010, efforts were made by BP to begin the cleanup process along beaches and shorelines. A sea-floor oil gusher continued to spew crude oil into the Gulf for 87 days until the leak was capped. In total, 210 million gallons of oil were dumped into the ocean due to BP’s negligence.
90,000 workers and over 7,000 vessels were assembled throughout the Gulf regions to begin containing, dispersing and removing the remaining oil and tar deposits in the summer of 2010.
The clean-up efforts utilized 1.84 million gallons of the dispersant COREXIT, which acted to emulsify oil deposits that would normally rise to the surface, leaving them suspended in the water and on the ocean floor. Many of those working on the spill did so without gloves, masks or any form of protection from the hazardous substances to which they were exposed.
A study performed in 2012 by the Georgia Institute of Technology later revealed that when COREXIT mixes with oil, it becomes 52-times more toxic.
COREXIT is banned in several European countries because it does not pass their laboratory toxicity tests and they feel it is unsafe for human exposure. The composition of COREXIT contains hazardous chemicals which are known carcinogens. If exposed, other chemicals which compose the dispersant can cause damage to red blood cells, the kidneys and the liver. Internal bleeding, blindness, and the buildup of chemicals in the flesh have also been witnessed. Some severe cases of exposure have led to death and many other debilitating conditions.
After only 3 years out from the spill, the long-term effects of exposure to crude oil and other dangerous dispersants are yet to be seen. To assist those who were exposed and became ill, BP created the BP Medical Settlement.
Current Status of the BP Medical Settlement
On January 11th 2013, the United States District Court in New Orleans granted final approval of the Medical Benefits Class Action Settlement Agreement. However, because two appeals were made to the settlement in February, no claims are being reviewed or paid out. In July, one of the appeals was dropped, but one is still being contested. Until this appeal is resolved affected individuals will not receive any financial or medical help from BP. The only move that has been made thus far is the Gulf Study, a research program sponsored by the US Government and BP to monitor the environment and individual health of those that were exposed to the oil and chemicals.
Why aren`t BP Medical Claims getting Paid
The remaining appeal was filed by Darrell Palmer, an Attorney from California with four clients out of Florida who suffered from exposure to the harsh chemicals. The Plaintiffs Steering Committee asked that a $50,000 bond be placed on Palmer which he would be forced to pay to continue the appeal. The judge placed that bond and Lawyer Theodore Frank paid it for Palmer and will continue the appeal in his place.
If the appeal is lifted, the BP Medical Settlement will have to start reviewing claims and paying the affected individuals. Some claimants can expect to receive up to $60,700 for damages they suffered. The conditions of the settlement would also allow them the right to litigate at a later date should any further spill-related medical conditions arise. Unfortunately at the moment though, all of this is at a standstill until the appeal on the settlement has been lifted.
People have become very sick from exposure to these carcinogenic chemicals, yet medical claims are not being paid. Many are out of work because of conditions imposed upon them by their past as a cleanup worker. Although the economy was highly affected by the spill, it seems as if people’s health is much more important than compensating a business for lost revenue.

BP Property Claims and VOO Claims get first look
The DeepWater Horizon Settlement Fund has certainly made a priority of paying VOO Claims and property Claims first. With over 3,300 Notices sent out, over 3,150 are either for BP Property Claims or for VOO Charter Payment.
VOO Charter payment accounted for over 2,500 Eligibility Notices for Payment. We told you VOO Claims would be the first to get paid months ago. We have gotten VOO Claims processed and paid in under a week.
BP Claims Status Report
On September 5th the Claim Administrator Pat Juneau , made available a report on the progress and the status of the claims review process. There are serious issues that they are encountering, they are trying to develop workarounds to these issues.
BP did not seem to be amendable regarding some of the workarounds. Shortly after the report the Department of Justice came out with a statement that they would be pursuing Gross Negligence charges against BP. A few days after that The Settlement Fund came out with a notice that some document requirements would be relaxed. Hopefully BP got the message, and this will allow for more claims to be paid, and faster processing.
According to the Report many claims did not have sufficient documentation.
- 40% are missing one or more required documents
- 52% of Represented and pro se Claimants Claims were incomplete
- 48% of the claimants had claims with the GCCF that were incomplete
- 8,100 claims have been reviewed since mid-July
The numbers of Business Claims, Seafood Compensation Claims, and Individual Loss economic claims that have received an eligibility notice for payment is tragically low. This will hopefully change as the documentation guidelines have been relaxed. They needed to be.
This what we have seen through our network, VOO Claims are getting paid, many of the VOO Claims we have gotten paid had already taken Quick Pays.
Many of our larger Business Claims and those in our Network, have Claims that have gone under review. Several firms in the Network have received offers for their Business Claims, most of these offers were accepted and considered to be fair.
BP Settlement Fund has much to Do
The report went on to say that The Settlement is trying to get out letters of determination to over 30% of the Claimants by October 1. We had been told they were attempting to do this by September 10th.
We have been recently told they will be sending out letters of determination to over 3,000 by the end of the week, with approximately 1/3 of them receiving offers, in essence by October 1, over 15,000 people should know exactly where they stand.
Time is running out for the BP Settlement, I do believe the people in leadership positions have the best intentions. I also believe that they are running head long into obstructions that have been there since the GCCF, and if these obstructions are not removed very shortly the settlement may not survive.
If BP does not play ball and actually try to move the process forward, instead of hiding behind their lawyers and legal wrangling, there will be serious ramifications, whether it is through a Massive Boycott, the D.O.J, or some other mechanism. I guarantee to you, it won`t be pretty.
The BP Oil Spill was their fault not Ours. We need to hold them accountable, and We will.
Issues that need to be Addressed
Some real areas of concern right now are revolving around the environment, Oysters in Apalachicola and the surrounding areas are not spawning. We all know that Corexit is to blame, I was told BP was trying to blame it on past storms. My suggestion to BP is to take FULL responsibility for ALL of the Environmental after shocks of this Disaster.
Medical issues are continuing to worsen for many. People that were on the front lines are dying from very aggressive cancers. The National Institute of Health that has been taking samples for months, are sending out very vague letters staying very clear of linking the Oil Spill or the use of Corexit to these peoples health issues. People are dying here, we need real answers, not rhetoric.
Quick Pays, one thing I have learned form many of the people that make a living from the Gulf is that many of you have have issues reading, and many of you took Quick Pays. There is not one doubt in my mind that you were preyed upon, this issue needs to be fixed, and fixed now. With all of the issues the fisheries are having and the catches dwindling as they have, people are getting very desperate out there, and something needs to be done for them.

The October 1 Opt Out date needs to be Extended
There has been a lot of conversations lately about the BP Settlement. A number of High Powered Attorneys would like to see the opt out date of October 1 to be extended. Personally I think it makes sense. The BP Settlement is just becoming better understood by so many. It wasn`t very long ago that we all got the terms of the settlement and got a handle on how to process BP Claims for the Settlement.
Everybody has had a pretty fast learning curve to grasp, new processing methods, new formulas, and more documentation. Do you all know what it is like to collect documentation, let me tell you all from first hand experience, it is not easy.
That being said, The GCCF has such an inconsistent methodology, rule changes when ever it suited them, a number of Attorneys and others decided to take a wait and see approach, and after a lot of disappointments with the GCCF, many were thinking more about going to trial then submitting anymore claims that were just not going to see the light of day under the GCCF. Initially I had some real issues with this, I went head to head with a number of Attorneys over this issue, but can now see the logic and their point of view, and to a few of them I apologize, you know who you are.
Then came the Settlement, new leadership, new guidelines, new timelines. The Settlement was granted preliminary approval on May 2, basically 3 months ago. Some of the Attorneys in this litigation have over 10, 000 claims some even more then 20,000 claims, that`s a lot of claims. There is no way on God`s green earth that with all of the claims the Attorneys have in house, and many are now processing in house, they can handle these kinds of caseloads in that amount of time, and if they are not granted more time the New BP Settlement Fund can be assured that these Attorneys will be opting out the MAJORITY of their case loads, and I don`t think any of us want that.
BP Settlement and Transparency
On a different note but in the same vein, we get a lot of calls from people that want to know where their claim is at with their Attorney, we tell them to call their Attorney, some Attorneys choose not to return phone calls, it would be a wonderful mechanism if people who had Attorneys could check on their claims without having to call their attorneys. This would eliminate a lot of problems, people would know where their claims were at, they may even be able to find out what documentation they need to provide, and it would help make the process more transparent all the way around. Some Attorneys have tackled this problem head on and created client portal so the clients can see exactly where their claims are at, we think that`s a heck of an idea, but also think it would be great if this was spearheaded by the leadership of the Settlement and it was done for all claimants, sorry guys, I know you have a lot on your plate but it would HELP a lot of people.
Corexit and The Oil Spill
Since I am on my soap box for this particular blog, lets talk about Corexit, sick people getting sicker and what we are hearing from you. There are two very alarming trends out there one is the amount of people that work in the water like oystermen dieing from strokes. Blood pressure spikes seem to be a common theme from everyone we talk to who has been in contact with Corexit. These men and women and particularly clean up workers, voo workers and oystermen are experiencing an exceptionally high amount of strokes and heart attacks. The National Institute of health is running around the Gulf taking hair and nail samples, this should speak volumes.
The other trend we are hearing about is the amount of women and families that are experiencing miscarriages and babies that have been born sick and not making it. Many of these people had direct contact with Corexit, and worked on the Oil Spill. this is a tragedy at the highest level, and why more has not been done to help All of these people I have no idea.
You didn`t think I wasn`t going to mention quick pays, anyone who reads this blog knows that of all the screwing of the people worst hit by the oil Spill, Quick Pays were the worst thing to happen to most of the fishermen and businessmen affected by the spill. Nobody ever even knew Quick Pays were going to be a part of the process, we all were told people would be able to take Final pays and Interim claims, which actually made sense. When Feinberg unleashed the Quick Pay Scam and suckered people into taking this blood money so they could save their houses, boats, cars and families he did the biggest disservice to The People of the Gulf, people did not even know how long their livelihoods would be affected, and for a messily 5k or 25k many gave up their right to Sue BP, this needs to be fixed and fixed soon.
Just a few thoughts and by the way I am for the BP Settlement we just have a few things that need to be addressed.

BP Settlement News from the Gulf: Shrimpers Stories
BP Settlement News from the Bayou. We have been hearing recently from shrimpers that are coming back in from the Gulf of Mexico and the Bays about the Health of the Gulf, the news is not good. Shrimp catches are down, way down. They are picking oil up in their nets more often then not. The shrimp and killfish they are finding in their nets have lesions, they are missing eye sockets, and they have a myriad of other issues.
The FDA says it`s fine to eat, we all know better. We have been told by numerous sources they just raised the testing levels of what is acceptable. The Shrimpers themselves have never seen anything like this in generations.
They are being forced to shrimp because many had taken Quick Pays, and it is the only hope of putting food on the table this year. The collapse of the Northern Gulf `s Seafood Industry can not be denied. If the BP Settlement does not address these issues, they in essence are forcing people to fish and exposing all of us to these deadly catches.
BP Settlement Quick Pays can still file Claims for VOO and Medical
If you took a Quick Pay or a final, you can still be a part of the VOO Settlement Class and the Medical Settlement Class under the BP Settlement. Many of you are sick but are attributing the High Blood Pressure to Stress and other factors. If you worked in the water or around the water during the Spring, Summer and Fall of 2010, odds are you are sick from the dispersant corexit and the oil.
There are tests that can help show this, one is called a Volatile Organic Compound Test, it measures the heavy metals in your body. If you are a fishermen, shrimper, crabber, and especially oystermen and clammer`s you need to go see a doctor.
We are hearing far to often of strokes and heart attacks, and are seeing a trend that is alarming. Many of you have not connected dots here. The BP Settlement can help you monetarily speaking, but you need to take the initiative when it comes to your health. The National Institute of Health is in the region taking hair, nail clippings and blood samples, they wouldn`t be there if it wasn`t serious.
The BP Settlement can only address so much, but the door is open if you took a Quick Pay to be a part of the BP Settlement for Medical and VOO Claims.
The BP Settlement and some random Thoughts
If the Northern Gulf goes into a full collapse, and experts are getting increasingly concerned about this, what do you think will happen to all the tourism. Owners of tourism and other related businesses please take note here. This will affect us all.
If the BP Settlement is to be fully utilized there needs to be some changes. First and foremost Quick Pays need to be addressed as soon as possible. You can not ask a man or a woman not to put food on the table for their families, if given the option of catching some tainted seafood, or their families starving, the choice is quite easy.
The BP Settlement needs to be proactive in its approach to paying people, especially paying those on the front lines. The BP Settlement should recognize the businesses that exist because of the Fishermen, Crabbers, Shrimpers and Oystermen, seafood processors and other assorted upstream businesses should receive higher multipliers if they choose to be a part of the BP Settlement.

BP Settlement Calculations.
Many people are having a hard time understanding the BP Settlement multipliers, we will try to help you understand your baseline payment under the BP Settlement.
Mind you this is just how you figure your baseline there are other factors and multipliers that will be added to complete your Settlement equation. There are various multipliers for various types of claims and the zones those claimants inhabit.
BP Settlement Zone A Example
Here is how you would find your baseline under the BP Settlement for a Zone A Business under the BP Settlement. Take 3 consecutive months or more from 2010 after the Oil Spill, take those same months in 2009, 2008, and 2007 and create an average. You can use 2009, 2009, and 2008, or 2009, 2008 and 2007.
So lets say you used 5 consecutive months in 2010 after the spill and you made 100,000.00. You then take the same 5 consecutive months for 2009 and 2008, and came up with an average of 175,000.00, therefore you had a 75,000 loss for 2010.
The RTP or Risk Transfer Premium is 2.5 which means your multiplier is 3.5, so take 3.5 X 75,000.00 and your total is 187,500.00, that is your baseline loss, there are multiple ways to increase that number under the BP Settlement, but it gets pretty complicated.
There are several different zones and Multipliers for different areas and types of claims.
Environmental and other concerns
Report after report has been coming out showing how disastrous the effects of corexit and oil have had on the environment and on us. The data is just flat out not pretty. A diver that had two of his colleagues commit suicide and he has seizures after diving through contaminated water after being assured by a BP executive it was safe.
The death and illness of the blue crabs and the Dolphins of Barataria Bay are front page news. We are seeing the affects of the Oil Spill everywhere.
One of the biggest concerns I have is the link to high blood pressure we keep hearing about, especially from the Oystermen and women who spent their lives in now contaminated water.The calls we have been getting are horrendous and come far to often these days. High blood pressure can lead to Heart Attacks and Strokes as well as death, please get checked out. We have heard that members of the National Institute of Health are coming in to investigate and we look forward to hearing the results.

As Judge Barbier Considers the BP Settlement I thought we would post some of the emails from people who took Quick Pays or were offered BP Quick Pays, we all know these people were starved out and Betrayed by the GCCF under Feinberg, Judge Barbier has an opportunity to make this right under the BP Settlement.
We would appreciate any consideration of adding these people back into the BP Settlement so they could be properly compensated. Many of these people work on or in the water they have been exposed to Corexit and Oil and have suffered the side effects of elevated blood pressure, rashes, bloody stool, and death by heart attack and stroke.

My name is John I am an Oyster Harvester of the Apalachicola Bay,for 30yrs now.I have surely seen better days out on the water since the BP oil spill and BP oil dispersant.
My father died in the Apalachicola Bay,so I feel a special connection to him being out there.It hurts me so seeing how much things have changed since the BP oil spill and oil dispersant.
This past year has been by far one of the worst and hardest oyster harvesting years.Being an Oyster Harvester for 30 yrs now,I know every oyster bed from Alligator Point to Indian Pass.I can take you personally to any one of them and show you first hand the effects the BP oil spill and BP oil dispersant have caused.
The state oyster beds that did produce have severely been worked down by so many oyster harvesters having to work only in the beds that did produce.Has this hurt our providing for our families, ABSOLUTELY! The oyster catch went from 30 to 40 bags in a day to 12 bags on a good day.Oyster sales are down due to the BP oil spill.
The first year,2010, BP made out like the BP oil spill and clean up would only last a year.That lead to the Quick Pay claim or pay-off.Yeah, BP gave you an option all right,take the Quick Pay claim or risk getting nothing.
Here it is 2yrs later and because of the BP oil spill and dispersant,the life for a Oyster Harvester is getting worse not better.Not only did the BP oil spill hurt the Oyster Harvesters,so has the BP oil dispersant.
It is in our bay,The Apalachicola Bay and BP is so responsible for it and our losses.Loss of income or lack of,reduce in production due to the catch of oysters per bags caught in a day.Also the limits set by Oyster dealers because of low oyster sales.
I took the Quick Pay and put that money into my oyster business counting on BP to do as they promised.My business has suffered greatly.I have had to sell to other oyster dealers not being able to have a sales route myself because of lack of catch and sales of oyster.Sales have been drastically reduced due to the BP oil spill having affected the Apalachicola Bay. Now I don`t qualify for the BP Settlement my last chance at being made right.
A family simply can not survive off this way of living anymore because of the BP oil spill and BP oil dispersant.
Who will help this starving way of life and living now?Who will make this better for the Oyster Harvester and other fishermen of The Apalachicola Bay and The Forgotten Coast Line?
My husband had invested much of his life to commercial fishing, always investing our hard earnings back into our business to have a nice home, to send our children to better schools, and school functions is a must with my husband, and I. We owe our lives to the Gulf of Mexico with its plentiful oysters, shrimp, and crabs to live upon, and to sell to our community consumers. My husband served our country as a Marine for four years, but that was years ago. I just want to let you know what a great husband and father he is, as well as a great person he his to our community, and state.
He was on the water about to go fish for crabs, but with so much stress that came with the BP oil spill he had a stroke on his sons birth date Aaron 3/16/1990. His blood pressure was 265 over 110 My husband stayed in Tulane medical centers ICU for 3 nights, and on the ground floor for 2 nights. The Doctor Mrs. Martin said it was acute stroke, saying it was “acute” meaning very bad. We are now in speech therapy, and taking the steps for him to get better.
BP or the press needs to know how they are making the commercial fishermen starve to take the $25,000.00. BP has our paper work, and the information needed to at least give us an intern payment, but never.
The BP assistant (rep) said in 2010 the oyster grounds were open. I say BULL, I have the paper clipping on that year, and lets not forget our oyster vessel could not work, due to the closure. BP must know with a 50ft oyster vessel, crab vessel with 400 traps are not just for there looks. Why would BP ever have a question about the payment if our family has these vessels in our own back yard?
Our family are now on food stamps, and getting little help from the church. I now have a $85,000.00 dollar hospital bill, and bills from his MRI, and other tests that the hospital ran to make sure he had no bleeding in his brain. He has lost more then the BP Settlement could every pay us now. Shame on you. We own a 50 foot oyster vessel, crab vessel with about 400 trips that we live on to pay our bills, but the spill has made the waters baron with no seafood to support our families living.
Can you see now how my husband had his stroke? I will call it a BP stroke! We never called an attorney yet, because we thought that would hold up any payment we might have received, but this is my husband! How can you do this to a family? Oh, and never mind about the main issue of people working at Popeye’s that receive money. Where are their vessels?
A very upset wife of a fishermen. I would like to ask whom ever is reading this if their loved one had a stroke? Well, let me tell you that the person whom had the stroke is not the same anymore. He can’t talk, he can’t think, he lost his humor. Very sad indeed.
I see the loss amount you would like me to give you, BP has taken my life, my husband, and a father away from me and my family. It would be hard to tell you how much of a loss this was. The hospital in itself is $85,000.00 and counting. To get my husband back to whom he was, priceless. I’m a very nice women, but this is the result of stress from the BP oil spill. Our total loss is $350,000.00 and counting.
We will Never give up Helping these people and others affected by the Oil Spill, for us it is personal and we are here for the Duration.

You see Corexit Bio accumulates in the bodies of what ever ingests it, when a shrimp eats zoo plankton, and a fish eats the shrimp, and we eat the fish, we eventually get sick, and that`s a fact.
A recent report has traced the Fingerprint of the oil spewed by the Deep Water Horizon to Zoo plankton and the carcinogenic hydrocarbons found in the Zoo plankton can be actually traced to the Deepwater Horizon accident. We have been hearing from many of you recently that have had children born with Birth Defects, loved ones who died unexpectedly after getting sick, usually from heart issues, not to mention many of you who worked the oil spill or resided close to the beaches that were affected.

Now we have been an advocate for the BP Claims Settlement because we know many of you need help after the GCCF so miserably failed, but we have some concerns about settling your BP Claims and they need to be voiced. BP and the GCCF had a plan from the very beginning to weed out and pay out as little as possible by dragging their feet and getting as many of you to sign Quick Pays as they could, and have no compunction of letting those who signed Quick Pays back to the table through the BP Claims Settlement, many of you are in the hardest hit industries, such as shrimping.
This is tragic, as homes went into foreclosure, and boats and cars were being repossessed, people were economically forced to take these Quick Pays, and that was all part of their plan, and finally when the BP Claims Settlement is about to take place, and it looks like you are finally going to be treated fairly, the last thing they want is this group back at the table. Who should Consider the BP Claims Settlement
If your Industry is not contingent upon with the Direct Health of the Gulf of Mexico and you live outside of the Areas that were most impacted by the Oil Spill, the BP Claims Settlement is pretty much a no brainer for you.
For example if you are a Realtor in Sarasota County, the waters of the Gulf seem to not have been affected there, strongly consider the the BP Settlement.

Why do we all HAVE to settle anyway, why can`t people just get paid for what they have lost so far and a little extra for pain and suffering, wasn`t the original intent for them to pay Interim Claims, that`s right, about the time they were suppose to pay Interim Claims they hit us with the Quick Pay scam.
The fact is everybody affected right now should be getting Interim BP Claims money, but instead the Interim Claims were thwarted by the GCCF and Feinberg. We shouldn`t even be talking about about a BP Claims Settlement, we should be studying the true extent of the damage and coming up with ways to fix it.
So now they are finally going to come up with a bunch of cash before we know ALL the facts, and that`s suppose to cure everything. Tell that to our children, and our children’s children. As cancer rates begin to shoot up across the Gulf, especially with those exposed to Corexit, just as it happened in Alaska.
All of this is happening while people are dying, yes dying from the oil and the dispersant Corexit that was suppose to clean up this mess. The EPA even told BP not to use the toxic dispersant, but BP went right along and still used it, when there were several other organic alternatives available.
I can not tell you how many people we hear from on a daily basis whose health has been RUINED by the use of Corexit during the Oil Spill Clean Up process, and there was never any remedy for that in the BP Claims process until now in the BP Claims Settlement Program. I am glad to see that those suffering from medical complications will finally see some relief, but can you really put a price on it.
The BP Settlement will help a lot of people, but why do we have to settle now, why not just give us what you owe us, and when we know the true extent, then Settle with Us, in years to come it will come to light that many settled on the cheap just like the people who took the Quick Pays did, remember it took THREE YEARS for the true extent of the Exxon Valdez Oil Spill to be felt environmentally and economically.
To this day only 15% percent of the Herring ever came back to Prince Edward Sound. So they are aiming at ending the BP Claims and BP Claims Settlement to be done in about 3 Years, don`t you think that is rather ironic. It took 3 years just to figure out what was going on the last time we had a tragedy like this, and that one pales in size and comparison.

BP Settlement Calculations
New calculations will come into effect for the BP Settlement they promise to be more generous. You will take 3 consecutive months from 2010 (your worst months) and then take the same months from preceding years, subtract 2010 from that average, use the multiplier assigned to your Industry and geographic area, the RTP (Risk Transfer premium) that should be a multiplier between 2 and possibly up to 7, add in your future trending, and you should come up with your BP Settlement figure. There is more to it, but this is the broad strokes of it.
The BP Claims Settlement has drawn quite a few skeptics.
Most of the skepticism comes from BP Claims Attorneys with large case loads that signed up tens of thousands of cases. Many of these attorneys in our estimation were bewildered by the whole BP Claims process, and how difficult it was to put BP Claims together and package them to the GCCF. BP Claims Quick Pays and Finals need to be addressed in the BP Settlement
The reason I am going over this story is because, now people that took Quick Pays or finaled out because they were basically starved out by the GCCF and Ken Feinberg are receiving the same treatment as the the sick people originally did and that is a huge injustice. The common use of a Delay, Deny and Defend Strategy needs to be overcome and is just not ethical in todays world. Here is an email we got yesterday the names will be omitted.
After the oil spill i filed a claim for the emergency help and did receive help. When they asked me to get them 08, 09, 10. Taxes We gave them what they needed 08, 09, 10, and they said they still needed more. So we went to Jackson Hewitt and had them fax 07, 08, 09 ,10. And would you know they still said they more information. Later we filed for the interim payment and did get what was suppose to be a 6 month payment, it was a check for like $3,500 and then they said they messed up and sent us like $1,800 more and then nothing else after that. JUST NEED MORE INFO. 4 time’s we gave them what they needed. Finaly JUNE of 2011 we just had to settle for the $25,000. Because my wife and i was about to loose my wife`s property that we live on together for 19 year’s. And she has lived there since she was 7 year’s old, For 32 year’s. And so on from there.
So here we are still in a bind and about to loose everything because have tried to catch them oysters there is nothing out there. Or no order’s do to no one wanting that many oysters.
So can we still get any help.

Well it has been a few days since the BP Settlement hit the wires. The phone hasn`t stopped ringing, people close to the Settlement have been weighing in through out the last few days, and the good news is, if half of what we have heard today is true, and you have legitimate BP Claims, even if it was denied, we can help you with your BP Settlement.

BP Claims Settlement Rumors: Final Payments may not be Final
If you took a final payment and it was not a Quick Pay you will have an opportunity to be included into the BP Settlement, this is believable, as you dissect the Oil Pollution Act, you can not take a final payout until the true extent of the damage is known.
If you took a quick pay you will not be eligible, I do expect Quick Pays to change as long as you have the documents to substantiate your claim. When Feinberg starved people out, then offered them Quick Pays it was one of the most callous moves during the process. It was awful , and one of the first things he did, as he shelved paying out Interim Claims for months.
BP Settlement and BP Claims New Leadership
Lynn Greer from Brown Greer out of Virgina will be the Interim Administrator of the fund. She is a fabulous choice, as she knows the process intimately. Many people did not know that the GCCF handed off claims to Brown Greer for processing, but that is just what they did. This will allow for seamless integration as the players are not changing, except for Mr Feinberg, but the process will be, as it will be easier to prove your claims with the new format.
Some Attorneys voice concern about the BP Settlement
A Houston-based attorney who represents people and businesses with roughly 12,000 spill claims, questioned whether the settlement will be more beneficial to his clients than the existing fund. We get calls daily from claimants whose claims were never even filed with any accompanying paperwork proving their claims, and some were never even filed. Claimants should not be victims of their Attorneys ineptitude. Anything would be better then the GCCF, oh, except if your attorney never even filed your claim. Find out your claims status is, and if your Attorneys are asking for paperwork get it to them.
