The BP Claims Settlement is Back On and time is running out..
Emails and letters are being sent by the leadership of the Settlement in mass.
However, the deadline to file of June 8 is fast approaching and requires immediate action.
We have found that many claimants have fallen through the cracks when indeed they had a justifiable business claim.
This was either due to mishandling by certain claims professionals or the confusion created by the complicated, and to some, misleading filing process.

If an Attorney/Processor has done their job, expect them to lien the file.
Judge Barbier has not taken kindly to Attorneys/Processors liening files that he found to have little or know time in.
The claimants still have RIGHTS, and need to know what they can do to keep their claims alive.
The mishandling of claims from certain vendors inside the settlement can not be ignored.
In my opinion hiring people unskilled in this process was a huge detriment to the whole settlement, and it is my belief, it intentionally was meant to thwart the whole process, and Pat Juneau and his staff became targets for trying to fix it, and thank God they did to a large degree by bringing in some very good processors and reworking the mess that was handed to them.

How BP Claims got lost in the shuffle
When the claims process was switched from GCCF to Deep Water Horizon, many claimants never fully transferred to the new process. Their information did, but needed forms, that to many looked like junk mail, were thrown in the trash.
Those claims can be brought back to life, your documents are still there.
The amount of people that had filed through the GCCF before transitioning over to the New DeepWater Horizon Settlement was around 1 Million.
The amount of claims ever filed with DeepWater far, far less.
The claim process was then halted during the Deepwater Horizon Settlement by Delay tactics by BP.
New rules like 495 and smoothing and matching tests were added.
What happened in many experts opinions is that 25% or so of what were thought to be solid claims will be ineligible, and will be documented to death.
What also happened was that the connection between the oil spill no longer applied for most Business Economic Loss Claims.
If your Business Claim meets the V Trend model for your zone you could get paid.
You just have to show a loss in 2010 for 90 or more consecutive days versus the same period in 2009, and an upswing for the same 90 or plus days in 2011. These ups and downs that make the V-Trend are different for every zone, and there are exceptions.
If you can also demonstrate you had even better numbers in 2007 and 2008 during those same 90 plus days you can also bring those years into the equation.
The critical dates in determining a loss are from 4/20/10 ( the day of the spill) to 11/31/10. for more on the V Trend go here.
You will need monthly p and l`s and tax records for the years and the time periods you use to substantiate your claim.
At this point in time keeping good records is a must to qualify for the settlement. Many of those records are still sitting in the DeepWater Database and just need to be revived.

The BP Settlement lifts Stays
Most people don`t know that certain groups of claims were on hold, Contractors, Farmers, Marketing Firms, Aquaculture Farming, Attorneys, CPA`s, Doctors, and quite a few more industries were just stalled. It was by design, BP and the Fund, were stalling these claims, as they sorted things out, and today Judge Barbier put a stop to it. The Deepwater Horizon Settlement led by Patrick Juneau with the help of Judge Barbier went to bat for the people. The people won.
This process has not been easy for many, about 2 days ago we were given a list of these stayed claims, it was something we thought was happening, but we had not seen it in black and white, this was an official list, it should have been made available to the general public. We are publishing it here..The Stay List is at the end of this post.
This is what we are seeing from the Fund, they are paying claims. We have long advocated for the settlement, and they needed time to get all of the wheels on the bus, the wheels are on the bus. We are seeing a rhythm to the claims process, claims are getting paid on a regular basis.
I wish I could say this is happening for everyone, but I can`t. I do believe that certain firms with credibility with the Fund are getting preferential treatment because they know that the Claims being presented are credible and have their documentation all together.
As a fact some firms are getting claims paid regularly, some are not, I think is based on the performance of those firms, and how they prepare BP Settlement Claims. The fact is some know what they are doing, and some just don`t have a clue, and that is recognized by the Fund. Now this is conjecture I am not a lawyer, but I know most of the players in this, and it`s just the way it is as I see it.

GCCF Claimants circle back to the BP Settlement
What we have also seen, is that many claimants have begun to circle back into the BP Settlement process that had given up after the GCCF debacle. The GCCF was a mess, it left people disheartened and disillusioned, the BP Settlement may have some issues, but it is far less arbitrary then it`s predecessor. Current Issues with the BP Settlement
- Some claimants still have not seen any progress of their claims through the claims review steps, this is unfortunate, but we have seen the process just recently begin to speed up, and I mean very recently.
- The customer mix test is still an obstacle for many businesses that are in Zone D, that don`t qualify under the standard V-Test model.
- Naics codes are being rumored to change or BP has asked to set aside those claims in the building field, not sure how this is going to unfold, but we are keeping a close eye on this development, again let me reiterate these are rumors at this point.

The BP Settlement Matures
With Judge Barbier`s final approval of the BP Settlement, combined with finally seeing a sample set of all types of claims get paid or receive offers, we more fully understand how different types of claims, in different zones will be treated.
Should we have had this understanding before the opt out date, sure, but we have to play the cards we have been dealt.
On the bright side our processing side can tell you if you have a claim, as long as you have the financials to support it, in hours, and not days.
The maturation of the DeepWater Horizon Settlement has accelerated our ability to process claims, and help people better understand if indeed they fit into the BP Settlement.
DeepWater Horizon Settlement Incomplete Claims
What many people and businesses are experiencing are Incomplete Notices, for many, these come one, after another, after another, after another, you get the idea.
It would be beneficial if the leadership at the DeepWater Horizon Settlement could facilitate it so that ONE CHECKLIST of everything that the Claimant or Claims Preparer needed to complete the Claim was furnished to them.

Settlement Zones and NAICS Codes
There are still some issues with Settlement Zones and NAICS codes, what is considered tourism, what is not tourism.
We are also seeing a large number of claims that are clearly in HIGH Volume Tourism Destination areas that don`t fit under the Tourism NAICS codes get labeled non-tourism.
There are cures for that, but as usual you have to jump through a few more hoops, and dot your i`s and cross your t`s.
The multiplier for a non tourism related business vs. tourism related business makes it worthwhile.

Old GCCF Claims
When the GCCF Closed it`s doors they had almost 1 Million Claims that they were processing, what happened to all of these claims, well for the most part, people and businesses did not update them for the BP Settlement.
The last update that I read from the DeepWater Horizon Settlement, they had approximately 91,000 people and business that had filed with the Settlement.
Within the Judges order he said they anticipated over 1 Million claims to apply for restitution.

The BP Settlement Fund has Issues, Real Issues
What in the beginning seemed to be a mechanism that would actually get all the people paid, that deserved to be paid, has abruptly turned out to have some very serious deficiencies. Are these deficiencies by design, or are they just inherent flaws. It would seem to most of the experts that I have talked to over the last week they are by design, and are hidden in the complex, over 1000 page document known as the BP Settlement Agreement.
What Happened to a Fair BP Settlement Agreement
For many of you that jump through all of the hoops, get in all your paper work, all the monthly p n l`s, dot your i`s and cross your t`s, odds are you will find one last obstacle, The Customer Mix Test. Instead of raising false hopes, and going through the process, the first thing they should have asked Businesses for was The Test.
If you don`t have records of where your clients came from and how much they spent, and can`t show a drop that the Settlement Fund requires, your dead in the water. This is the last test they will throw at you, just when you think you are about to get paid, if your a business, and specifically in Zone D, this could be the nail in your coffin, for most of you. We are attempting to work around this issue.
NAICS Code Issues
If your company is based in a tourist Area, and can show a steady stream of clients, with significant drops in and out of season, and in 2010 versus 2009, but does not have the proper NAICS code, and can not show records and logs, you will not see the standard tourism RTP or Multiplier, but you will be left scratching your head, when you receive an offer substantially less then what you thought you were owed. We have been told that The Settlement is working on these issues.
We are hearing from Attorneys and Processors everyday that they are seriously bewildered to what they saw as the Goodwill of the Settlement Fund in the beginning get perverted. New rules seem to be applied everyday, the real issue here is those rules were in the document from the beginning, they were just not enforced when the first wave of payments came out. Now we are seeing rules and tests be applied that were never used in the initial first wave of payments at a more frequent rate.
BP is saving money and it is costing the People Billions.
Word on the Street
Now I am not saying this is true or not, I am not a lawyer, but this is the way it was layed out for me, and I have to say it makes a lot of sense.
If you recall The DeepWater Horizon Settlement had dragged its feet making payments on a large scale for some time. It was not until after the Opt Out Date did we finally see some payments to the Claimants. Actually many of the offers had been made to the Claimants before the Opt Out Date and finally delivered to them after the Opt Out Date. Many Industry Experts felt pretty good about the Settlement at that point.
Therefore many Attorneys advised their clients to stay in the BP Settlement, what we never had was a good sample set of Claimants of all different types and Zones going through the BP Settlement. Yet many believed the first wave was a good sign of things to come. The second wave would prove far different.
The Right way would have been to let people evaluate what they received as a Settlement, and then let them decide whether or not they chose to accept the Settlement figure, or then decide to litigate.
What people would eventually find out is that, there were a number of traps lying in wait. The Attorneys and the general public would not find out about many of these until much later, why because the Settlement had been stalled, so by the time the Opt Out Date had come and gone, then and only then would the trap be sprung. It always seemed odd to me that the Opt In date would be further extended, but the Opt Out Date would not.
That trap is called the Customer Mix Test. It is almost impossible to pass the Customer Mix Test for most Businesses.
Many Attorneys supposedly in the KNOW, firmly believe that the Plaintiff Steering Committee is too close to BP. They further believe the Administrators of the Fund have their hands tied, because all they can do is administer the fund under the Judges supervision, and the Judge is basically bound by The Settlement. The administrators need to have more autonomy For him to make changes, he would have to get BP and the PSC together to do so, and to agree to the changes.
Now I don`t know if these Attorneys are wrong or right, all I know, is that there are real issues here, and I would be remiss if I did not point them out. I also believe that the Judge, the Administrators, PSC members and yes even BP are all trying to reach common ground, my big point here is don`t B.S. us while trying to reach it, give us the facts, be upfront, and if needed be flexible.
The Judge has still not Signed off on the BP Settlement
The only silver lining right now is that Judge Barbier has still not signed off on the BP Settlement, it is expected that he will very shortly, with no substantive changes. There is still hope for many of the claimants that have fallen into this trap, but it is fading fast.
What many fail to realize is that the PSC was in negotiations with BP for a long time, during that process there is a lot of give and take, and in the end they crafted what we know today as the BP Settlement. It must be looked at as a mechanism that does the most good for most of the people and businesses, that were the most affected. However the tactics, and the way they were deployed, are questionable at best.
The issues are that there were serious mechanisms/tests that were not put in play. The general public and the Attorneys were led astray, because they never saw a TRUE SAMPLE SET of claims, and that did not happen UNTIL AFTER THE OPT OUT DATE, and that is just not FAIR to the 1000`s perhaps 10,000`s more that would have most likely been advised or chosen to opt out.
Many wonder why these issues, and others, especially the plight of the sick people injured by Corexit have not been brought into the Public Eye more, it is thought by many it is because BP has spent so much in advertising in our local medias, buying tv, radio, and print, all in the hope of staving off the truth. The truth will come out sooner or later, it always does.
Now let me say this, we have found the fund for the most part, great to work with, we have gotten many claims paid, but there are issues, and they need to be addressed, sooner then latter.

DeepWater Horizon Settlement Fairness Hearing News
Yesterday was a big day for people that are or want to be a part of the DeepWater Horizon Settlement. Attorneys from around the Gulf and beyond, brought up their objections and opinions to Judge Barbier, they addressed the issues that they had with the BP Settlement.
Some Attorneys had some very valid points especially around people that had fallen ill, and it was pointed out that though there is a lot of testing going on, what about actually helping the people that are sick. There has not been one red cent allocated for that, and some of these people are seriously ill, and the settlement may not work for many who are seriously ill. They need help now.
My overall opinion of how the Judge handled things was very good, he smelled out self serving attorneys, that were just trying to make changes in the Settlement in minutes, and quickly exposed their true motives. He was genuinely concerned in what he saw as glitches within the Settlement. In the end he went through the pros and cons and mentioned how the Exxon Valdez still has some proceedings going on 23 years later, and he didn`t want that to happen here. He spoke highly of Pat Juneau and the work he and his staff are undertaking, and in the end I believe he will sign off on the BP Settlement.
My Belief is the DeepWater Horizon Settlement will be approved.
There are still alot of issues that need to be addressed, I`m not sure how they will, but for sure they will one way or another. The DeepWater Horizon Settlement will not be a platform for them however. When the Settlement is ratified it will be exactly as you see it today, atleast that`s what I am betting on.
There are attorneys that are taking in clients that took quick pays based upon signing under duress, especially fishermen, and people making a living from the Water. It seems as though they are particularly interested in these claims, and who knows if they get somewhere with these, it could open the door for others.
The Settlement should mature from what we have seen so far as processes are refined, staff is put into the proper places according to need, and an overall better system evolves.

BP Settlement Opt Out Date may Change
Well it looks like the BP Settlement Opt Out date could quite possibly change once again, I have been hearing about this for the last week. Its beginning to sound more and more real. We are hearing January or even March, I do not believe this will effect the pace of BP Claims getting settled, I believe we will actually see an acceleration.
With some Attorneys beating the drum to opt out, and do it now or else face the consequences, the BP Settlement Fund with the Help of Judge Barbier could seriously be doing everyone a huge favor by extending the deadline once again, and they should.
Do Not Opt Out, not yet anyway
Now once again I am not a lawyer, this is by no means legal advice, but give the BP Settlement and the people running it a chance. This is not the GCCF, they are about as far apart from the Feinberg Regime as they can be.
If you want to consider Opting Out do it around Mid October if the date hasn`t changed. Those of you with serious medical claims, and others such as seafood processors may also want to consider it. There are some groups that just don`t belong in the BP Settlement unless a few things change, but that`s a topic for another blog.
The BP Settlement is Paying Out
There has been a dramatic shift since September 17th, We have seen offers and claims go into review at an accelerated pace We have seen people that were originally naysayers become believers, just visit our Facebook page. I have taken a very deep and personal interest in it. The BP Settlement Bus has left the Building.
The Leadership of the BP Settlement has one goal in mind.
They want to Pay You, as long as your claim is valid
They are in the midst of being much more hands on, and putting everybody on notice that is not on board with the new regime. They also need cooperation, they need the PSC and BP to get on the same page and stay there, they need some flexibility so they can make decisions that will help them get the job done, and they need to stop dodging bullets from Prominent Attorneys and Officials, give Pat Juneau and David Duval a chance, and if you can help clear the road for them, do so.
Most of all they need their Processors specifically One in particular to step it up, there has been a lot of information that has crossed my desk and others lately, and their methodology has raised a lot of eyebrows.
The process has unequivocally been stalled by them, and guess what everyone know`s that now, and I mean everyone. The depth of their inability and hiring practices have been disclosed, and there is more, oh so much more.
If companies involved in this continue to place profit before the people, there is going to be an uprising, and the BP Settlement Fund will be looking for another processor. Bet on it.
The BP Settlement needs Your Help
If you are reading this blog, and can in any way help things move a long do it. There are far too many people trying to throw monkey wrenches at this, instead of looking at this as an opportunity for self gain, look at this an opportunity to forward this part of the BP Settlement along.
There will be other aspects of this Settlement that need to be addressed, such as Quick Pays, figuring in 2011 numbers, possibly 2012 numbers, and so much more. Lets just get on the same page, put some effort behind what we now have to work with, and address these and other issues as we can.
The BP Settlement is not one size fits all, but if we all pitch in together we can probably help a heck of a lot more people, and isn`t that what this is really all about. The Deepwater Horizon Settlement is a heck of a way to get a whole lot of people paid, and get them paid now.

An offer was received on August 27th, the claimant accepted the offer.
The Claimant was notified that all of his economic claims would then be handled under the terms of the DeepWater Horizon Settlement and agreed to that. The claim was handled for a 15% contingency fee.
There were several other BP Claims paid by our groups, they included Business Claims and more VOO Claims.
BP Settlement Calculations Dead On
The processing center that handles the majority of our large loss claims figured a BP Claim for approximately $359,540.00 the offer was for $359,410.00 they were off by $130.00.
We are thrilled with the accuracy of their calculations, this group also only charges 15% and only gets paid when the client gets paid.
Franklin County and Apalachicola Oystermen need Help
The more I have been hearing from Oystermen in Apalachicola, the more concerned I am for their future welfare.
It seems as though there is no new growth on the Winter Bars where they harvest Oysters.
The September 1 Oyster Season is right around the corner, Franklin County Commissioners are looking for help from BP and the EPA immediately.
The dispersant Corexit is most likely to blame, it has also caused a spike in Heart Attacks and Strokes in the Oystermen and Women`s communities.
This needs to be addressed immediately, members of the National Institute of Health have been taking hair and nail samples for months, enough sampling already, get these folks and others help now, people need to be made aware of the effects of Corexit.
Hurricane Isaac Stirs up the Gulf and Bays
Hurricane Isaac has pummeled Louisiana, Alabama, Florida, and Mississippi, Oil from the BP Spill will be hitting the shores of Our Beaches. Submerged Oil Mats known as SOM`s will be breaking apart and relocating. These mats still consist of 17% crude oil.
If you see Oil on the Beaches or in the Bays we want to hear about it, and take pictures if you can.

October 1 Opt Out Date Extended to November 1
We have been advocating for an Opt Out date extension for sometime now we are glad to see it got done. This will give the Attorneys more time to see how their clients fit into the settlement. The DeepWater Horizon Settlement Fund should be able to provide a large amount of offers on claims submitted to provide a sample set, of what we can all expect in the mean time. This will help us all evaluate BP Claims and get a feel for what will fit into the BP Settlement and what will not, and that is about to happen.
