Judge Barbier Approves the BP Settlement
If you follow the doomsday theorists, 12/21/12 was suppose to be the end of the world, well, not really, it was the first day of the official BP Settlement. Any connection, probably not, but Judge Barbier did lay a compelling and substantive case as to why The DeepWater Horizon Settlement should move forward. You can read it for yourself here.
There are issues with the settlement, but the fact of the matter is we all just want to see people and businesses get paid, and this is what we have to work with. There was a lot of interesting information in the 125 page document. Most compelling was the Judges rebuttals of the numerous objections raised. The Judge provided his thoughts in great detail as to why he thought certain objections did not have merit, or were basically outweighed for numerous reasons, citing a variety of case law.
I still believe there are issues with the Customer Mix Test and NAICS codes, but much of that can be handled with an Appeal, and we will all see how those Appeals are handled. If David Duval who heads up the BP Settlements Appeals division can get adequate compensation for the BP Settlement Claims that deserve it, and if he is given some latitude in correcting NAICS codes and other assorted anomalies, then I think the BP Settlement is a strong substitute for litigation. We will see how this aspect of the process unfolds, and how much leeway he and his Team are given. There is a lot riding on this aspect of the DeepWater Horizon Settlement Structure.
Seafood Compensation Program (You have 30 Days)
Under the terms of the BP Settlement, people that are taking part of the Seafood Compensation Program only have 30 Days after the Judges approval to present their claim to the DeepWater Horizon Settlement Fund for Approval. That means the clock is ticking and if you haven`t filed yet, you need to.
BP Settlement Numbers
91,000 people had so far filed with DeepWater Horizon Settlement Fund. They expect that number to hit over 1,000,000, hopefully many more will come to the table now that the Judge has formally approved the BP Settlement.
Excluded Claims Have Until January 19th to be Presented to OPA

GCCF Denials and Stalled Claims
If you had filed with the GCCF and been denied or been stalled, there is still hope for your claim under the BP Settlement. For all of its flaws, and it still has a few, in this writers opinion it is a whole lot better then what the GCCF was under Mr. Feinberg. It is transparent, it has a clear methodology, and it is not arbitrary. The folks that run the DeepWater Horizon Settlement want to pay you, and many claims that were shunned by the GCCF are welcomed under the terms of the BP Settlement.
Multiple Store Locations
We have seen a tremendous growth in Companies with multiple stores, in multiple locations, making BP Settlement Claims with us as of late. DeepWater Horizon Settlement Fairness Hearing News
Yesterday was a big day for people that are or want to be a part of the DeepWater Horizon Settlement. Attorneys from around the Gulf and beyond, brought up their objections and opinions to Judge Barbier, they addressed the issues that they had with the BP Settlement.
Some Attorneys had some very valid points especially around people that had fallen ill, and it was pointed out that though there is a lot of testing going on, what about actually helping the people that are sick. There has not been one red cent allocated for that, and some of these people are seriously ill, and the settlement may not work for many who are seriously ill. They need help now.
My overall opinion of how the Judge handled things was very good, he smelled out self serving attorneys, that were just trying to make changes in the Settlement in minutes, and quickly exposed their true motives. He was genuinely concerned in what he saw as glitches within the Settlement. In the end he went through the pros and cons and mentioned how the Exxon Valdez still has some proceedings going on 23 years later, and he didn`t want that to happen here. He spoke highly of Pat Juneau and the work he and his staff are undertaking, and in the end I believe he will sign off on the BP Settlement.
My Belief is the DeepWater Horizon Settlement will be approved.
There are still alot of issues that need to be addressed, I`m not sure how they will, but for sure they will one way or another. The DeepWater Horizon Settlement will not be a platform for them however. When the Settlement is ratified it will be exactly as you see it today, atleast that`s what I am betting on.
There are attorneys that are taking in clients that took quick pays based upon signing under duress, especially fishermen, and people making a living from the Water. It seems as though they are particularly interested in these claims, and who knows if they get somewhere with these, it could open the door for others.
The Settlement should mature from what we have seen so far as processes are refined, staff is put into the proper places according to need, and an overall better system evolves.

A recent order coming from Judge Barbier has ordered us to post Disclaimers stating that: This is not the Official Court Authorized Website. We put up a disclaimer on DeepwaterHorizonSettlementClaims.com as soon as the issue came to light. That evidently was not good enough for them or the Judge. So in the next day or so we will be putting their disclaimer on all of our websites.
It was never intention to be mistaken for the their website, if you read our websites and many do on a regular basis, the idea that we are trying to mislead people into thinking we are their website is preposterous. Just read the websites, there is no way that people can mistake us for them.
We have taken the strongest stands for people that have been hurt by BP, the GCCF, some Attorneys, and have been vocal and I mean very vocal about what is really happening to all of us on an economic, environmental, and medical level.
