BP Claims Czar Dropped the Ball

When the the Deep Water Horizon blew up, causing the most catastrophic oil spill we have ever seen, BP took action paying people, the payouts were called called Emergency Advanced Payments. EAP`s as they became known were collected by many who were injured by the BP Oil Spill. Often when people think of getting paid by BP they are referring to these EAP`s. That`s because when the emergency claim period ended November 23, of 2010, and Ken Feinberg officially took over and created the Gulf Coast Claims Facility, very few larger claims were paid. The primary purpose of the GCCF was to pay people Interim Claims and Final Claims and process those BP Claims. The Interim Claims were meant to keep people and business`s afloat as the extent of the damage was evaluated and the true financial toll on people and business`s could be quantified. There was NEVER any mention of BP Quick Pays previously in the BP Claims process.

Quick Pay versus BP Claims

On December 13th, 2010 Feinberg changed all the rules and came out with the Quick Pay option, touted as a quick solution for those in the BP Claims Process.  The BP Quick Pay`s would initially only be offered to the business`s and individuals ( 25k and 5k respectively) that had successfully received an EAP, that would also change as it became an instrument to prey on the desperate. All of this while Feinberg was telling the public that he and the GCCF were Independent of BP, it would later take a court ruling to get him to stop. When history looks back on this manipulation of the public trust by Ken Feinberg, it will go down as a black mark on the Obama Administration, and Ken Feinberg`s legacy. Over 100,000 people and business`s took the Quick Pay Option, many regret it.  Anyone receiving a BP Quick Pay would give up their right to sue BP, and agree not to pursue their BP Claims. Meanwhile the GCCF and Feinberg would put BP Interim Claims on the back burner.

BP Claims Czar not Independent

Many like to say hindsight is twenty twenty, a quick look back at Feinbergs actions and his manipulation of the BP Claims process can only come up with one conclusion. He does work for BP. Judge Barbier may have put it best in his ruling regarding Feinberg`s claims of being Independent. Judge Barbier said “While BP may have delegated to Mr. Feinberg and the GCCF independence in the evaluation and payment of individual claims, many other facts support a finding that the GCCF and Mr. Feinberg are not completely ‘neutral’ and independent from BP.” Because of this many people who signed off on the BP Quick Pay, may be able to sue BP, the Judge has not made his ruling yet, regarding whether people were misled by Mr. Feinberg, or coerced because of duress. This could open the BP Claims process back up for over 100,000 people. The BP Claims process has some history to it now, and if you stop listening to the words from  Mr. Feinberg, but look at his actions since he took over, the conclusion is simple, he is here to save BP money and delay your BP Claims.

You can make BP claims with the Gulf Coast Claims Facility created by BP and Ken Feinberg, who promised to ” Make it Right.” They also said your BP Claim would be handled within 90 days after the Emergency Claims deadline of November 23, 2010, but many who filed right after the deadline are still waiting. It is mid-June now and individuals and businesses have been waiting 9 months for their BP Claims money, only to hear we need more documents or their case is under review. Even worse, many people waiting for their BP Claims money, were told they were denied or simply offered the 5k quick pay for individuals or the 25k quick pay for businesses as long as they agreed not sue BP.

The best results I have seen for people going through the BP Claims process has been to hire a BP Claims Attorney. Instead of the GCCF being able to use bullying tactics, good oil spill attorneys will handle them for you. Instead of being offered for 1- 2 years of losses from BP, which I still have not heard of happening, oil spill attorneys will ask for 3-5 years of losses and handle negotiations for your BP Claims money for you. They will also push for interim payments so that you have some time to evaluate the true impact of the oil spill on you or your business.  Many interim claims payments have been accompanied by final settlement offers. Now mind you the GCCF could have a change of heart between now and then, and become immensely fair and truly try to make it right, but again I wouldn`t bet on it; it just doesn`t fit the present corporate culture when it comes to handling BP Claims.

“BP’s position is not that every single claim needs to be dismissed,” Andrew Langan, BP’s lawyer, told U.S. District Judge Carl Barbier at today’s hearing. Claims that have been improperly filed or not yet presented to BP’s trust fund should be dismissed, he said.

So in essence BP does not want to pay your BP Claim if you made a mistake on your BP Claim or  if you haven`t filed one yet. Unless I am reading this way out of context, and I don`t think I am, BP is trying to mitigate it`s damages and block people from becoming part of the BP Claims process, if they have not already received your BP Claim, or they made a mistake filling it out. The truth is more then 70% of those eligible still have not filed their BP Claims.

Report Blames Obama, BP Claims not getting paid

The committee, chaired by Darrell Issa, said: “Many believe BP is not meeting its obligations and the federal government has abdicated its responsibility to intervene. The report also strongly criticized Barack Obama’s administration for failing to take charge of the clean-up and compensation, slamming the President for placing “the perpetrator of a reckless and unnecessary tragedy at the helm of the recovery operations”. The BP Claims Process has created the following according to the report “excessive compensation delays, inconsistent judgments, requirements that victims relinquish further claims against BP as a condition of compensation, and efforts to dissuade victims from obtaining legal representation.”

The report cited several glaring examples of the lack of consistency in the BP Claims Process. perhaps the most glaring was two fishermen in the Lafourche Parish who filled out very similar claims and had similar incomes, but one received $100,000 more. We have heard even worse BP Claims inconsistencies, for example we have often heard of two waiters or waitresses at the same restaurant, making the same money, putting in identical claims, only to have one claim accepted and another rejected. The BP claims process has been anything but fair.

BP Claims and You

I urge you to look at your income from previous years compared to 2010 and 2011, I urge you to look at the value of your Business, if you notice a drop, and it is in anyway connected to the Oil Spill, I strongly urge you to file a BP Claim. If you lost revenue, and it is Oil Spill related you are entitled to file a BP Claim. Personally I believe the whole Gulf Region was shutdown during the whole spill, and people immediately stopped spending. Some areas are rebounding faster then others, but what does the future hold?

BP set aside 20 Billion dollars to settle the BP Claims. According to recent articles, BP thinks it can get them all settled for less then 5 Billion, last month they thought they could have everything settled for less then 10 Billion, in essence BP just saved 5 Billion Dollars in one month, and do you know whose pocket that 5 Billion Dollars came from, it came from YOURS. This is perhaps the most common thing I hear when I am answering the help line.
