BP Claims the History and the Reckoning

BP Claims the Tragic Truth

The BP Claims process was better handled by BP then the Gulf Coast Claims Facility. When BP decided to make things right for the business and individuals affected by the BP Oil Spill, they utilized the Emergency Advanced Payment system. Commonly referred to as EAP`s people scrambled to receive EAP`s from BP and many were paid. Though the EAP system was far from perfect, and many got left on the sidelines, many were indeed paid. Then the reigns of the BP Claims payment system were handed off to Ken Feinberg on November 23rd 2010. Interim payments were suppose to come from the Gulf Coast Claims Facility first. Those economically injured by the Oil Spill were filing their Interim BP Claims and Final BP Claims with the GCCF and through Attorneys. The fact is they were not paid for several months and then it was only a trickle of claims getting paid. Ken Feinberg had unveiled a new BP Claims system at Christmas time called the BP Claims Quick Pay.

The GCCF uses Quick Pays to Pay BP Claims

The BP Claims process at Christmas time morphed into the the BP Claims Quick Pay system. Instead of paying Interim and final BP claims as promised the Gulf Coast Claims Facility put all of their energies behind the Quick Pay System. After not being paid for many months, some since April when the spill began, many took these Quick Pays so they could put food on the table, save the home, or the business. The fact is that the 5k offered to individuals, and the 25k for businesses offered temporary relief for many at best. Over 100,000 people took these Quick Pays and the majority regret that now.

Interim BP Claims were Shelved

BP Claims that were promised to come first , in the form of Interim Claims, were in essence shelved in favor of getting Quick Pays paid by the GCCF. In speaking with the Attorneys that we have connected with, it was not until mid March that the first Interim claims started coming in. That is 11 months from the date of the Oil Spill. How many people and businesses have a reserve of 11 months, not many. The aftermath of those decisions by the GCCF has been felt through out the Gulf. We hear daily from people who lost their business after trying their best to keep it afloat, then lost their homes and cars, and then had to move in with in-laws or friends. Many families disbanded.

GCCF and BP Claims Dirty Tricks and Stall Tactics

We are seeing a lot of BP Claims finally being made offers, many were waiting for over 6 months, until they got into Team members hands. The one thing and probably the most troubling is that there is a reoccurring pattern, they were stalled after the GCCF, letters of deficiency were often issued, some were denied, then the GCCF would offer the businesses 25k making it seem like they were doing them a favor. This has happened over and over again, and at this point it seems to be a GCCF strategy. The GCCF is still stalling claims, and recently a BP Claims Adjuster that was working with the GCCF has gone public about her experiences while working there, and yes she along with others was told to to stall BP claims.

BP Claims Where are we at Now

BP and the GCCF are on the ropes, after over a year since the Oil Spill the truth is coming out. Whether it was the report about BP being guilty for all of its carelessness being released last week, or the audit that is coming up for the GCCF, the news is not going to be good. The BP Claims process is coming under scrutiny, the BP Claims process needs to be righted. We have seen thousands of claims come through our sites many of them have gotten help here. The GCCF is paying BP Claims that are prepared correctly. We can help you with your BP Claims.

BP Settlement: Claims may settle out for 30 Billion Quickly

BP Settlement: Insider says BP about to pay 30 Billion to settle BP Claims

BP Claims

BP Settlement Claims News: A BP insider reported to Reuters that BP may want to settle many its BP claims after the February trial date. The trial would solidify who was at fault for the Macondo well blow out. A recent report that was finished this week, put the blame squarely on BP`s shoulders. Halliburton and Transocean did share some of the responsibility, but due to the lack of oversight, cutting corners, and not releasing all the information to it`s partners, BP was ultimately responsible for the Gulf Disaster. report

My sources that are very involved with the litigation and the BP Claims process think that BP will make a large push to settle out as many claims as possible, before the February trial date. We are seeing BP Claims get paid at a record rate. By both Adjusters and Attorneys.

Your Claims value may have jumped exponentially

For Example: A Claim that was 7k may be worth 25k, this is because certain thresholds in the mass settlement will have to be reached. BP Claims that were 100k could conceivably go up to 300k or more. The exact formula has not yet been revealed, but sources close to the litigation, including an Attorney that we have been forwarding  many of your claims to, has already uploaded all of their cases to the GCCF. Why is this happening, Punitive Damages, people and businesses that were directly affected by the Oil Spill are able to receive extra money for their losses, and this scares the heck out of BP. Hence BP is getting ready to settle now.

Why will BP try to settle its BP Claims before the February trial date.

There are multiple answers to this question.

1. The BP Claims process is about to be audited by Eric Holder at the urging of Jim Hood. In my opinion this will uncover what many of us already know. The GCCF under Feinberg was slow to pay and it preyed upon desperate people by not coming through with BP Claims interim payments in a timely manner, instead denying valid  BP Claims, or giving already desperate people and Business`s Quick Pays.

In my opinion Quick Pays, having BP Claims Under review,  denying valid BP Claims, where tactics that have been used as extortion to those hoping to get paid in a timely manner. I further think that though there are a lot of good people that work at the GCCF, that the top brass at the GCCF wanted to slow things down, and in fact did so. This will be revealed by the Audit, that is forthcoming and BP and the GCCF will be held accountable. Hence it pays for them to settle now before the full picture develops.

2. BP will want jurors to believe that they have indeed tried to make things right in the Gulf before the February trial date. A massive payout to claimants before the trial starts will boost the GCCF statistics and good will. The GCCF loves to point out positive statistics, the fact still remains that most of those that have been paid out have been paid out under the Quick Pay system.

3. BP needs some positive PR. The longer the events from the OIl Spill drags out, the more BP`s reputation and business practices get tarnished. If they decide to drag this out as more news comes to light surrounding  how the oil spill was caused, and how people that people that were affected were largely ignored, by BP and the GCCF, it is my opinion that this could spur multiple lawsuits, mind you I am not a lawyer.

4. Mitigation, Mitigation, Mitigation, there is no good news lately for BP and they need to cut their losses,  the best way for them to do so is to make some realistic offers and to get people to accept final settlements so people don`t go and sue them down the road. BP Claims punitive damages for those directly affected by the oil spill are now applicable. The forthcoming news for BP  and the BP claims process is not going to be any good for BP and Gulf Coast Claims Facility.

GCCF May Revise Payment Guidelines

GCCF may reduce payment Formula

GCCF Claims Czar

Ken  Feinberg mentioned reducing his two-time formula in November on Tuesday. Some multipliers have been as much as a seven times 2010 damages. Citing a return to normalcy, as tourists are coming back, and things are improving in general, the GCCF may have to restructure the formulas it has been using for Oil Spill Claims. In November the GCCF will review and possibly revise the guidelines it uses for GCCF claims. He will be taking into account the input from environmental and economic experts regarding the effects of the Oil Spill.

GCCF Is paying Oil Spill Claims

What we are seeing now is that GCCF claims that have come through our site are getting paid, and that often the GCCF formulas don`t necessarily apply if your claim is explained to them by seasoned Oil Spill Claims Expert. We have seen an uptick in Oil Spill Claims getting paid, many of them within 45 days of being filed, or being refiled. The advent of BP Claims professionals who truly understand the Oil Spill Claims process has a lot to do with this. These Oil Spill Claims Experts understand the Claims process, they know what you need to bolster your claim, and they know how to explain it to the GCCF. Many have formed relationships with the  people at the Gulf Coast Claims Facility.

GCCF Claims

So what do you do if you have a GCCF claim and it hasn`t been filed yet, or it is still sitting at the Claims Facility. If you have tried handling it yourself and the Gulf Coast Claims Facility does not seem to be cooperating, find a professional, if you think you can handle it yourself, by all means do. People in the hospitality industry specifically waiters and waitresses have seen some success here. If you have a business claim, and you want to maximize what you are owed, fill out the form to the right. Business claims are best handled by professionals, that can explain your claim. BP Claims professionals receive from 15% to 33.3% if you need the help of an Attorney. They don`t get paid until you do. We are here to help you navigate the waters of the GCCF.

The GCCF is Paying Oil Spill Claims

GCCF Claims that went though our site are getting Paid

GCCF Claims are Getting Paid

We are seeing a strong trend of GCCF Claims that have come through our site getting paid. We are happy to announce that the majority of all the claimants that have come to our site, are getting their claims paid, or their claims are at the GCCF. Why, because the groups that are processing the claims have experience putting Oil Spill Claims together.

Get what you deserve from the GCCF

We have put together an Incredible Claims Team that consists of former BP Claims Catastrophic Adjusters, Accountants, and BP Claims Attorneys. They have experience of getting your BP Claims paid, they are Oil Spill Claims Experts. They can Help you with Denied Claims, Claims that are stalled at the GCCF, and of course they can help you file a new claim with the Gulf Coast Claims facility. We can Help You Get what you deserve from the BP Claims Fund.

GCCF Offers

Has the GCCF made you an offer that you think is to low, it happens all the time. We can help you get what you actually deserve from the GCCF, different types of claims, have different calculations that are needed to substantiate your claims. The Gulf Coast Claims Facility is prone to making low ball offers, we can check out the offer, and tell you if you deserve more. All of the interim claims that I have seen come through are accompanied by a BP Claims final offer, you do not have to take the final offer, and personally I would not.

BP Claims Unsolicited 25k Offers

ffff

BP Claims receive Unsolicited Offers

BP Claims

The GCCF is making unsolicited offers for your BP Claims. As it turns out they are calling people with valid BP Claims, and offering them BP Claims Quick pays in many instances. Many of these people are business owners who lost more then the 25k they are being offered for their Oil Spill Claims. If you receive any of these offers, and want to speak to an expert regarding your Gulf Coast Claims, we can help you get straight answers regarding your BP Claims.

BP Claims Experts

All BP Claims experts are not the same, there are law firms, accounting groups, claims adjusters, all trying to get a piece of the Oil Spill Claims pie. I am proud to say that hands down we have put together the best people in the country to handle your Oil Spill Claims. They are known in the Industry, and yes their is now an Industry around the BP Claims process, as the preeminent experts in their respective fields. We have a BP Claims Calculations expert, we have a BP Claims litigation expert, and a firm specializing in people that have gotten ill during the oil spill. The Claims Team that we have assembled is truly at the apex of their respective fields. Remember that all members of the BP Claims Team are separate entities, but many of them are now collaborating together to get your BP Claims paid.

BP Claims Paperwork

When you are preparing for the BP Claims process have your tax records, w-2`s, and bank records ready for 2008, 2009, 2010. If you are a business, have a P and L ready for 2009 and 2010, they are now asking for 2011. Get all the paperwork together you can to substantiate your loss. If you were layed off as a result of the BP oil spill, as the financial effects trickled down through the economies, get a letter from your boss. If you are a business that lost a contract due to the oil spill, ask for a letter from the client who had to cancel the contract. Do not overburden the GCCF or people handling your Gulf Coast Claims with extra un-needed paperwork. It slows down the process and allows for more error, we are very well aware of the fact that the GCCF mislabels paperwork in your file, less documentation can be a benefit, overwhelming the process with lots of irrelevant paperwork will not help your BP Claims.

If your Oil SpillClaims have been denied there are a number of options available. Members of the Team can reorganize and recalculate your claims all while it is sitting at the GCCF. People who have tried to handle their claims themselves and been denied 3 times have utilized members of our Team, and gotten their claims approved, one within 9 days, though that is not the norm, it usually takes about 45 days. If your Claims have other issues such as causation, moratorium, or other legal challenges it maybe best to speak with one of our noted Claims Attorneys. BP Claims and GCCF Fight Begins

BP Claims making the News

BP CLaims Czar

I have been writing for about a month now about BP Claims and the ensuing battle for transparency with the GCCF and Ken Feinberg. BP Claims Lawyers have asked Judge Barbier to appoint a Special Master to the 20 Billion Dollars Oil Spill Claims Fund. Attorney Generals from the Gulf States have asked Judge Barbier to look at complaints that the GCCF is intentionally Delaying, and Denying BP Claims in order to pressure oil spill victims into taking BP Quick Pays. Attorneys for the Plaintiff`s also charge that the GCCF is not in compliance with the Oil Pollution Act, and that all the Quick Pays deserve a second shot at the BP Claims Fund.

Today GCCF Lawyers Defend their Handling of BP Claims

The Attorney for Ken Feinberg, David Pitofsky said in court filings that the BP Claims Funds accomplishments show that there is no need for court oversight. He went on to say that they are overseen by several committees in Congress and the Coast Guard. When asked about the BP Claims Quick Pays he said that “It can be a perfectly rational decision to accept an assured short-term payment over a possibly larger, but postponed long-term payment. He also said that “claimants are drawn by the immediate cash for their BP Claims.”

GCCF Tactics regarding BP Claims

The GCCF is utilizing a Delay, Deny, Defend tactic when it comes to paying your BP Claims. The GCCF is ever changing what they are asking people for regarding documentation, and the BP Claims process is ever shifting and becoming more forensic. People are receiving unsolicited offers from the GCCF mostly in the form of Quick Pays. Many of the Quick Pays that are being offered by the GCCF are far lower then what BP actually owes people and business`s affected by the BP Oil Spill.

What to do about Your BP Claims

Quite simply put them in the hands of a BP Claims Expert, whether you use one of our BP Claims Team members, or find your own. BP Claims Team members are getting oil spill claims paid. We have been working with many of them since the beginning of the spill, and they are doing a fine job getting people paid. We have added some new members that are filling niche`s as new developments in the BP Claims process need to be addressed. BP Claims Team members can look into your claim while it is at the GCCF, and figure out why it is being delayed, cure any deficiencies, and explain your claim to GCCF staff in order to substantiate your claims. BP Claims members can help if your claim was denied, and of course they can help you if you are filing a BP Claim for the first time. All Team members work on a contingency basis, and their fees start at 15%.

Best of Luck with your BP Claims.

The GCCF and the BP Claims Process

This week GCCF Claims got Paid

GCCF Claims Office

One of the Claims Professionals we work with received 14 offers on Friday alone, why, because they are very good at organizing and maximizing GCCF claims, or going into your claim while it is at the GCCF recalculating the claim and curing any deficiencies. They have a reputation at the GCCF for being spot on when it comes to their calculations, and not leaving any money on the table. There are true BP Claims professionals who know how to deal with the GCCF, and you can find them here.

GCCF Claims Professionals

There are organizations that have a handle on the BP Claims process, there are law firms, accounting groups, and claims adjusters that have all had success with the GCCF. Some are better with smaller individual claims, while others handle more complex business and personal claims. Sometimes your BP Claims are better off in the hands of an Attorney because of causation issues, and a myriad of other challenges the GCCF may bring up. There is a lot to be said about placing your claim with the right group from the beginning, that truly understands the GCCF and the process.

GCCF and BP Claims Preparation

The GCCF and BP Claims process has been difficult for many people, and many professionals to get a grasp on. The fact is the GCCF methodology, and the trending incorporated within in change on a regular basis. People and business`s are getting oil spill claims paid by the GCCF. Many claims are being held up, because they lack proper documentation, or have been improperly filed either by the GCCF, or by oil spill claimants. It is vital when preparing your GCCF claim that you give them exactly what they ask for, nothing more and nothing less, as it leads to confusion, and allows more room for error. If your BP Claims are not being paid in a timely fashion, and most are not, demand answers from the GCCF. If your BP Claim seems like it should be more, and the GCCF is not explaining it to your satisfaction, put it in the hands of a GCCF professional.

GCCF and BP Claims Develpoments

The GCCF is Being Sued for BP Claims Delay

BP Claims Office

The Florida Lawsuit claims that BP Claims are not being paid in a timely fashion in an effort to starve the claimants so that they will accept just a miniscule amount of what they are actually owed. The Attorney points out something we have said for months on this blog that BP is using a Delay, Deny, Defend Strategy.

Feinberg has been under heavy fire from Plaintiffs Attorneys as well as the Attorney Generals from the states bordering the Gulf of Mexico. The fact remains that only a fraction of Interim Claims have been paid, and these were the initial solution that would give time for people and business`s to evaluate the devastating effects fro the BP Oil Spill. Instead of helping people put their Interim Claims together they came up with the BP Claims Quick Pay, which for all intensive purposes, was used as a mechanism to give starving claimants a fraction of what was owed, while they signed off their rights to sue BP.

Lets Look at what officials have BP Claims Issues

Alabama Attorney General Luther Strange said the GCCF payments “do not amount to much” and Alabama residents have been “reduced to begging for handouts from an organization … whose primary missions seems to be turning them down.”

Mississippi Attorney General Jim Hood filed a request that Barbier intervene in the GCCF process.

The Gulf States of Alabama, Mississippi, Florida and Louisiana have all criticized Feinberg and the GCCF, on how they have handled your BP Claims.

Louisiana Governor Bobby Jindal and Attorney General Buddy Caldwell wrote a memo criticizing Feinberg and said he was not complying with the Oil Pollution Act known as OPA.

Now there is an Audit underway led by U.S. Attorney General Eric Holder.

Recent GCCF and BP Claims Developments

Recently several groups that receive your information from the Review Form on the right have met with Mr. Feinberg and other officials at the GCCF. The GCCF and Mr Feinberg has made them a lot of promises as they went over your BP Claims. Over the course of the next few days one of the leading Attorneys that has literally thousands of BP Claims many of them coming from this site, will be sitting down trying to settle as many BP Claims as they can. It is my hope that they have great success and settle as many BP Claims as possible and people actually get their BP Claims paid.

I have met  with Mike Rosen myself, he is Ken Feinberg`s law partner, we had a nice, very informative conversation, that was over 6 months ago. I walked away thinking that these guys care and really want to help people. The fact remains the BP Claims process would not have all of the above mentioned critics including me if it was working properly.

As my Grandfather always said, Actions speak louder then Words.

Now a little word of advice to the GCCF stop talking, and just pay people`s BP Claims

25k BP Claims Quick Pay is No Gift

BP Claims Quick Pay touted by the GCCF as a Gift

BP Claims Quick Pays

According to our BP Claims Experts more then 50% of the BP Claims Quick Pays calculate out to be substantially higher then the 25k settlement offer. It doesn`t matter if your losses are 50k or 500k and supported by BP Claims documentation. I can`t tell you how many people I have spoken to that regret taking the BP Claims Quick Pays. The GCCF is surging ahead these days making BP Claims Quick Pay offers to business`s owners in mass. Often they will tell you, you don`t have all your paperwork together, or your oil spill claim is deficient in some way. Often the GCCF will deny your BP Claims only to circle back to you, and offer you the Quick Pay, making it seem like a gift. Let me assure you, the GCCF BP Claims Quick Pay is not a gift.

BP Claims Audit is on it`s way

The GCCF is not handling the BP Claims process fairly and people know it. The Attorney General from Mississippi (Jim Hood) and the Attorney General (Eric Holder) for the United States is taking them to court to audit the BP Claims process. Mr. Hood tried to get the information from the GCCF but they kept stalling him, sound familiar. In a last resort two of the top Attorneys charged with protecting the Rights of the People are gearing up to do battle for the People. If BP and the GCCF were handling the BP Claims process correctly, this would not be necessary.

BP Claims Quick Pays may get a second chance

A group of Attorneys have filed papers with Judge Barbier in New Orleans asking that the Judge review the Quick Pay system, because they charge that they are illegal under OPA. They further charged that BP Claims Quick Pays were offered to people that were under duress, and forced to take the BP Claims Quick Pays. If the Judge rules in favor of the Attorneys it could mean that people and business owners that accepted the Quick Pays could get a second chance to get what they deserve from the BP Claims Process.

What to do about your BP Claims and Quick Pays

First don`t let them pressure you into accepting the BP Claims Quick Pay, understand that this is part of their strategy to buy you out of suing BP for future damages. You need to get a second opinion on your BP Claims settlement offer from the GCCF, whether it is a Quick Pay or a Final Settlement. We have teamed up with several groups  that will review your Claims Settlements at no charge, and if you have been offered a Quick Pay of 25k, they will only charge you for any any recovery above the 25k. There really are people out there that will help you with your BP Claims. Fees start at 15%, fill out the form to the right and start getting help with your BP Claims. Our Experts can also look at your oil spill claims while they are still a the  GCCF, if they are Under Review or have been Denied, there is help for your BP Claims.

BP Claims and Sick People

Feinberg is evading BP Claims for Illness

BP Claims and Sick People

A few months a go Feinberg said he had not seen any BP Claims for illness related from the BP Oil Spill. Then Mr. Feinberg said he had only heard of a few hundred BP Claims resulting from the the Oil Spill. The folks that worked on oil spill clean up, and the bathed in the water, or lived close to the coast and breathed in airborne Corexit are sick. We have received numerous calls from people who filed BP Claims going over their illness all with very similar stories and none getting relief from the BP Claims process.

BP Claims Process and Illness Claims

Feinberg is under heavy fire for not taking action within the BP Claims process for illness claims. His record supporting people that have illness claims in the past regarding agent orange and 9/11 is strong. Knowing that these sorts of claims were going to be raised again in the BP Claims process should have been taken into consideration. It took years to act upon the Agent Orange and 9/11 claims, and we should have all learned from that. Feinbergs excuse is that it is going to take time to know the true extent of the damages as it did in prior cases. The fact is people affected by the Corexit and oil don`t have that much time, and need help now, and not just monetary help but Medical Care, though some ongoing financial help in the form of BP Claims would help.

BP Claims vs. Litigation for Sick People

As it stands the only recourse as I understand it, is for people to sue BP for exposure to Corexit and oil. We have been forwarding your information to Attorneys that are taking action on the behalf of people that have gotten sick, and many of these people have found solace that they are being represented by one of the best Law Firms in the country. The BP Claims process is broken in so many places, and the inability for the process to take into consideration the people who have gotten sick from BP`s carelessness is a testament to it`s inadequacies. I call on Mr. Feinberg to fix, evolve, do so something for these people, other then making them part of a study, because people are dying here, this is about medical help now, and some sort of money that can help them as they can`t work, this needs to be figured into the BP Claims process. This process need to evolve so they can be considered into the BP Claims Process
