People upset with the BP claims process marched on D.C. Monday as they showed their discontent towards Ken Feinberg and the Gulf Coast Claims Facility. The protestors were organized by former comedian/actor turned activist Dick Gregory and Art Rocker chairman of Operation People for Peace. The coalition wants President Obama to answer the needs of its members as they think Ken Feinberg and the Gulf Coast Claims Facility have not met the needs of the people affected by the BP Oil Spill.

GCCF Closes doors to BP Claims Offices

All of this is happening as the Gulf Coast Claims Facility is closing 8 more GCCF offices, making it even more difficult for people to file for their BP Claims. The people of St. Bernard Parish are rallying to keep their GCCF office open so they can file their BP Claims, receive updates and get answers. St. Bernard Parish Councilman Frank Auderer,  said the fishermen “are already struggling, so we need to have an office in our area to service those people that have not been serviced yet.” Many of the people of St. Bernard Parish make a living from the resources of the Gulf of Mexico, the people of the parish for the large part have not been paid, does it really make sense for the GCCF to close their office.

The Gulf Coast Claims Facility has shown no mercy for incomplete BP Claims. Many of the claims are not incomplete but simply mislabeled.
This has led many to believe that the GCCF is intentionally misleading people and business’ filing claims. The fact is the GCCF has told attorneys that they can file claims that are not complete. Though a few offers have been made, many are still facing deficiency and denial issues. This is an overt act on the GCCF`s part to confuse an already difficult process. Make sure when you are asked for BP Claims documents that you furnish all of the ones the attorneys or BP Claims adjusters ask for.

BP Claims Audit on Track

Perhaps the biggest news is about the audit. The U.S. Senate voted Tuesday to move forward with the GCCF audit. The proposal was spearheaded by Marco Rubio and Roger Wicker and was passed as an amendment to a package of spending bills. It should be noted that Jo Bonner and Jim Hood have been tackling this issue for some time. This would insure a review of the process that the Gulf Coast Claims Facility uses to evaluate and pay out claims of economic damage resulting from the oil spill. Hopefully this will get to the bottom of something that should have had more government oversight for some time.

Moratorium BP Claims back on the Table?

Ken Feinberg is making statements that he wants BP to pay for the workers and businesses affected by the moratorium. This is an expected move from Feinberg. As he comes under fire from other areas, he usually tries to offset the scrutiny by doing something positive. He said he needs BP`s permission to do this. It would bode well for him if he could get their cooperation on this issue. The only reason drilling was shut down was because of BP`s shortcuts. Giving people back what the moratorium stole from the people and businesses would only be fair. Moratorium Claims should be paid.

Breaking news has been released that 53% of the gulf shrimp that were tested contained PAH’s (polycyclic aromatic hydrocarbons).  There has been consumption warnings issued, and shrimping continues to be affected drastically.  We are just beginning to realize how much the environment has been impacted since the oil spill and you can be sure we will continue to hear even more devastating news.  Ken Feinberg has been reprimanded by Capitol Hill for the way has chosen to handle the BP Claims process. He inferred the shrimpers would get some much needed relief.

With BP Claims deadlines approaching and BP claims offices closing, the Gulf Coast Claims Facility has prolonged a state of disarray in the BP Claims process.  Thousands of people are stuck in the delay or deny tactic the GCCF has decided to continue on those directly affected by the Oil Spill.

What we found out about the BP Claims process.

The GCCF has made the claims process almost unbearable for those who suffered loss from the oil spill.  We have acquired a much better understanding of what is going on inside the GCCF and how the claims process is working behind the closed doors of the GCCF.  This has given us a much better understanding of what exactly the GCCF is looking for when processing your claim.

BP and the GCCF are trying to skate around BP Claims Consultants and have a more direct exchange with individuals filing claims on their own.  In doing this the GCCF is aiming to interact only with individuals themselves on their settlement offers and decisions in hopes that the individuals will take low ball offers because of their lack of knowledge and advice from a professional. Can you blame them?  Claimants must sign and agree that a BP Claims Consultant be made aware of any new information or decisions being made.  This does not include Attorney’s at this time.  If you would like to have your claims consultant included in your decision of settlement be sure to send the signed document stating that all information on your claim should also be sent to your BP Claims Adjuster.  Do not take a low ball offer without seeking advice from a professional.

While the Gulf Coast Claims Facility and BP are supposed to be making everything right it also seems they are in the business of trying to frustrate people who have legitimate BP Claims, and hoping they will just go away. This is a tactic that is used by unscrupulous insurance companies and it does work. The GCCF often mislabels documents within their file for your claim, then you are given a letter of deficiency and many find themselves sending in the same paperwork they all ready have sent to cure the deficiency. The GCCF is also slow to process claims, they have a history of telling people that your claim has gone to the next level, and saying everything looks good for it, but when it goes up the chain, you are asked to wait for more determinations, we have also heard of GCCF Claims that have gone to the accounting department and claimants are told the check is forthcoming, only to get denied or asked for more information. For many it is like being a hamster in a wheel, running fast to go nowhere.

BP Settlement Claims News: A BP insider reported to Reuters that BP may want to settle many its BP claims after the February trial date. The trial would solidify who was at fault for the Macondo well blow out. A recent report that was finished this week, put the blame squarely on BP`s shoulders. Halliburton and Transocean did share some of the responsibility, but due to the lack of oversight, cutting corners, and not releasing all the information to it`s partners, BP was ultimately responsible for the Gulf Disaster. report

My sources that are very involved with the litigation and the BP Claims process think that BP will make a large push to settle out as many claims as possible, before the February trial date. We are seeing BP Claims get paid at a record rate. By both Adjusters and Attorneys.

Your Claims value may have jumped exponentially

For Example: A Claim that was 7k may be worth 25k, this is because certain thresholds in the mass settlement will have to be reached. BP Claims that were 100k could conceivably go up to 300k or more. The exact formula has not yet been revealed, but sources close to the litigation, including an Attorney that we have been forwarding  many of your claims to, has already uploaded all of their cases to the GCCF. Why is this happening, Punitive Damages, people and businesses that were directly affected by the Oil Spill are able to receive extra money for their losses, and this scares the heck out of BP. Hence BP is getting ready to settle now.

Why will BP try to settle its BP Claims before the February trial date.

There are multiple answers to this question.

1. The BP Claims process is about to be audited by Eric Holder at the urging of Jim Hood. In my opinion this will uncover what many of us already know. The GCCF under Feinberg was slow to pay and it preyed upon desperate people by not coming through with BP Claims interim payments in a timely manner, instead denying valid  BP Claims, or giving already desperate people and Business`s Quick Pays.

In my opinion Quick Pays, having BP Claims Under review,  denying valid BP Claims, where tactics that have been used as extortion to those hoping to get paid in a timely manner. I further think that though there are a lot of good people that work at the GCCF, that the top brass at the GCCF wanted to slow things down, and in fact did so. This will be revealed by the Audit, that is forthcoming and BP and the GCCF will be held accountable. Hence it pays for them to settle now before the full picture develops.

2. BP will want jurors to believe that they have indeed tried to make things right in the Gulf before the February trial date. A massive payout to claimants before the trial starts will boost the GCCF statistics and good will. The GCCF loves to point out positive statistics, the fact still remains that most of those that have been paid out have been paid out under the Quick Pay system.

3. BP needs some positive PR. The longer the events from the OIl Spill drags out, the more BP`s reputation and business practices get tarnished. If they decide to drag this out as more news comes to light surrounding  how the oil spill was caused, and how people that people that were affected were largely ignored, by BP and the GCCF, it is my opinion that this could spur multiple lawsuits, mind you I am not a lawyer.

4. Mitigation, Mitigation, Mitigation, there is no good news lately for BP and they need to cut their losses,  the best way for them to do so is to make some realistic offers and to get people to accept final settlements so people don`t go and sue them down the road. BP Claims punitive damages for those directly affected by the oil spill are now applicable. The forthcoming news for BP  and the BP claims process is not going to be any good for BP and Gulf Coast Claims Facility.

Judge Barbier made some key Rulings that affect BP Claims

BP and Halliburton: The Oil Spill Blame game

According to Halliburton, BP should have known about an additional hydrocarbon zone that they allege BP failed to disclose. Haliburton goes on to state “The motive behind BP’s intentional nondisclosure of the upper hydrocarbon zone is apparent — profit and greed,” “changes that likely would have required a redesign of the production casing,” “Such changes would have cost BP millions of dollars on a well that was already painfully over budget and behind schedule.” In speaking with many of the Attorneys on our Team this fits with BP` corporate culture about putting profit before safety and environmental concerns. This could help prove extreme negligence on BP`s part.

Tropical Storm Lee whipped up the Gulf Coast this week throughout the Gulf Coast region, tarballs were spotted on Orange Beach, but there wasn`t any major incidence of submerged oil mats coming ashore except on Fourchon Beach. They are out there, som`s as they are being referred to. There have been reports that the Macondo well is leaking again, that was inspected by BP and the Coast Guard in ROV`s, but no evidence was found that the sheen, seen clearly from the air around the well was coming from the well, more on that as the story unfolds. Some of the Fishermen I have been talking to have reported several dead zones. There are still a lot of ecological concerns that remain unknown, only time will tell.
