Judge Barbier stuck to his guns today and dismissed BP`s objections to how the Claims Administrator ( Pat Juneau ) was administering the BP Settlement process. If you follow our blog this is exactly what we had predicted.
BP is expected to appeal to the 5th circuit, where once again they will most likely not find any relief, why, because they signed the BP Settlement, and they will not be allowed to rewrite it.
Pat Juneau is doing an excellent job administering it, and everyone knows BP is just out to save money.
BP was trying to change the Settlement so they did not have to pay people in the following Industries.
- Construction Industry
- Agriculture Industry
- Professionals such as Lawyers, CPA`s, and Doctors
- and more, its a long list, etc., etc., etc.
The BP Settlement is what it is, consider it etched in stone, and if you meet the terms of the Settlement you will get paid.
Judge Barbier also commented on BP suing Pat Juneau for doing his job today. He said, “As a matter of law, how can a claims administrator be in breach of his contract if all he’s doing is applying it as he believes it should be applied, and now as ordered by the court?” Barbier asked. “How can that possibly be a breach of contract.”
We applaud the Judge for sticking up for the people and the Claims Administrator today.
Incomplete BP Claims
The biggest issue many have had is presenting a proper BP Claims package to the DeepWater Horizon Settlement Fund. This results in the majority of incompletes.
There have been other issues that we hear about on our facebook page of people getting incompletes for information that is already in the claim package, we heard of that more frequently about 6 months back, but evidently there still may be some issues, however we hear about this far less frequently now.
Some of this has been learning curve issues for those of us in the processing business, but after getting a number of successful claims through, we pretty well have this down to a science.
What people who handle their own BP Claims fail to realize is that when you handle literally hundreds or thousands of claims, as we and our strategic partners do. We build relationships with the people processing the claims, we have Liaisons CPA`s, and processors, that all work within the DeepWater Horizon Settlement infrastructure, and quite often instead of getting Incomplete notices we get a phone call or an email, letting us know what we have to adress. This saves time, and frustration.
Liens and Lawyers
The Judge also admonished a few attorneys today for putting liens on BP Settlement Claims. We have been hearing a lot about this recently. If an Attorney has put a lot of time into a file, and the person decided to go elsewhere, the Attorney may elect to put a lien on the file. That is understandable, what is not understandable is when you may have engaged them but never gave them any information and they try to put a lien on your file for 25%. It gets even crazier when the client claims he never even engaged the Attorney, but the Attorney is still putting a lien on their file, and that has happened.
AR1`s help clients move from one firm to another
There is an apparatus in the DeepWater Horizon Settlement that deals with the lien issues, we will probably see this come into play more often in the near future. There is also a form known as an AR1 that allows clients to move from one attorney to another, or from an Attorney to a processor, or vice versa. Ar1`s have made moving claimants from one firm to another much easier.

BP Settlement Opt Out Date may Change
Well it looks like the BP Settlement Opt Out date could quite possibly change once again, I have been hearing about this for the last week. Its beginning to sound more and more real. We are hearing January or even March, I do not believe this will effect the pace of BP Claims getting settled, I believe we will actually see an acceleration.
With some Attorneys beating the drum to opt out, and do it now or else face the consequences, the BP Settlement Fund with the Help of Judge Barbier could seriously be doing everyone a huge favor by extending the deadline once again, and they should.
Do Not Opt Out, not yet anyway
Now once again I am not a lawyer, this is by no means legal advice, but give the BP Settlement and the people running it a chance. This is not the GCCF, they are about as far apart from the Feinberg Regime as they can be.
If you want to consider Opting Out do it around Mid October if the date hasn`t changed. Those of you with serious medical claims, and others such as seafood processors may also want to consider it. There are some groups that just don`t belong in the BP Settlement unless a few things change, but that`s a topic for another blog.
The BP Settlement is Paying Out
There has been a dramatic shift since September 17th, We have seen offers and claims go into review at an accelerated pace We have seen people that were originally naysayers become believers, just visit our Facebook page. I have taken a very deep and personal interest in it. The BP Settlement Bus has left the Building.
The Leadership of the BP Settlement has one goal in mind.
They want to Pay You, as long as your claim is valid
They are in the midst of being much more hands on, and putting everybody on notice that is not on board with the new regime. They also need cooperation, they need the PSC and BP to get on the same page and stay there, they need some flexibility so they can make decisions that will help them get the job done, and they need to stop dodging bullets from Prominent Attorneys and Officials, give Pat Juneau and David Duval a chance, and if you can help clear the road for them, do so.
Most of all they need their Processors specifically One in particular to step it up, there has been a lot of information that has crossed my desk and others lately, and their methodology has raised a lot of eyebrows.
The process has unequivocally been stalled by them, and guess what everyone know`s that now, and I mean everyone. The depth of their inability and hiring practices have been disclosed, and there is more, oh so much more.
If companies involved in this continue to place profit before the people, there is going to be an uprising, and the BP Settlement Fund will be looking for another processor. Bet on it.
The BP Settlement needs Your Help
If you are reading this blog, and can in any way help things move a long do it. There are far too many people trying to throw monkey wrenches at this, instead of looking at this as an opportunity for self gain, look at this an opportunity to forward this part of the BP Settlement along.
There will be other aspects of this Settlement that need to be addressed, such as Quick Pays, figuring in 2011 numbers, possibly 2012 numbers, and so much more. Lets just get on the same page, put some effort behind what we now have to work with, and address these and other issues as we can.
The BP Settlement is not one size fits all, but if we all pitch in together we can probably help a heck of a lot more people, and isn`t that what this is really all about. The Deepwater Horizon Settlement is a heck of a way to get a whole lot of people paid, and get them paid now.

BP Property Claims and VOO Claims get first look
The DeepWater Horizon Settlement Fund has certainly made a priority of paying VOO Claims and property Claims first. With over 3,300 Notices sent out, over 3,150 are either for BP Property Claims or for VOO Charter Payment.
VOO Charter payment accounted for over 2,500 Eligibility Notices for Payment. We told you VOO Claims would be the first to get paid months ago. We have gotten VOO Claims processed and paid in under a week.
BP Claims Status Report
On September 5th the Claim Administrator Pat Juneau , made available a report on the progress and the status of the claims review process. There are serious issues that they are encountering, they are trying to develop workarounds to these issues.
BP did not seem to be amendable regarding some of the workarounds. Shortly after the report the Department of Justice came out with a statement that they would be pursuing Gross Negligence charges against BP. A few days after that The Settlement Fund came out with a notice that some document requirements would be relaxed. Hopefully BP got the message, and this will allow for more claims to be paid, and faster processing.
According to the Report many claims did not have sufficient documentation.
- 40% are missing one or more required documents
- 52% of Represented and pro se Claimants Claims were incomplete
- 48% of the claimants had claims with the GCCF that were incomplete
- 8,100 claims have been reviewed since mid-July
The numbers of Business Claims, Seafood Compensation Claims, and Individual Loss economic claims that have received an eligibility notice for payment is tragically low. This will hopefully change as the documentation guidelines have been relaxed. They needed to be.
This what we have seen through our network, VOO Claims are getting paid, many of the VOO Claims we have gotten paid had already taken Quick Pays.
Many of our larger Business Claims and those in our Network, have Claims that have gone under review. Several firms in the Network have received offers for their Business Claims, most of these offers were accepted and considered to be fair.
BP Settlement Fund has much to Do
The report went on to say that The Settlement is trying to get out letters of determination to over 30% of the Claimants by October 1. We had been told they were attempting to do this by September 10th.
We have been recently told they will be sending out letters of determination to over 3,000 by the end of the week, with approximately 1/3 of them receiving offers, in essence by October 1, over 15,000 people should know exactly where they stand.
Time is running out for the BP Settlement, I do believe the people in leadership positions have the best intentions. I also believe that they are running head long into obstructions that have been there since the GCCF, and if these obstructions are not removed very shortly the settlement may not survive.
If BP does not play ball and actually try to move the process forward, instead of hiding behind their lawyers and legal wrangling, there will be serious ramifications, whether it is through a Massive Boycott, the D.O.J, or some other mechanism. I guarantee to you, it won`t be pretty.
The BP Oil Spill was their fault not Ours. We need to hold them accountable, and We will.
Issues that need to be Addressed
Some real areas of concern right now are revolving around the environment, Oysters in Apalachicola and the surrounding areas are not spawning. We all know that Corexit is to blame, I was told BP was trying to blame it on past storms. My suggestion to BP is to take FULL responsibility for ALL of the Environmental after shocks of this Disaster.
Medical issues are continuing to worsen for many. People that were on the front lines are dying from very aggressive cancers. The National Institute of Health that has been taking samples for months, are sending out very vague letters staying very clear of linking the Oil Spill or the use of Corexit to these peoples health issues. People are dying here, we need real answers, not rhetoric.
Quick Pays, one thing I have learned form many of the people that make a living from the Gulf is that many of you have have issues reading, and many of you took Quick Pays. There is not one doubt in my mind that you were preyed upon, this issue needs to be fixed, and fixed now. With all of the issues the fisheries are having and the catches dwindling as they have, people are getting very desperate out there, and something needs to be done for them.
